Article 387. Evasion of conscription for Military Service Criminal Code of the Republic of Kazakhstan

Article 387. Evasion of conscription for Military Service Criminal Code of the Republic of Kazakhstan

 

     1. evasion of conscription for this service in the absence of legal grounds for dismissal from military service –

     it is punishable by a fine of up to one thousand monthly calculation indices, or involvement in correctional labor in the same amount, or public works for a period of up to four hundred hours, or restriction of freedom for a period of up to one year, or imprisonment for the same period.

     2. The following:

     1) by harming one's own health;

     2) by false pretexts of being ill;

     3) the same action committed by forgery or other deception –

     it is punishable by a fine in the amount of up to three thousand monthly calculation indices, or involvement in correctional labor in the same amount, or public works for a period of up to eight hundred hours, or restriction of freedom for a period of up to three years, or imprisonment for the same period.

     Warning. If a conscript voluntarily arrives at the conscription point before the investigative body submits the case to the court, he is released from criminal liability.
