Article 392. Intentional illegal crossing of the state border of the Republic of Kazakhstan Criminal Code of the Republic of Kazakhstan

 1. intentional illegal crossing of the state border of the Republic of Kazakhstan outside the checkpoints across the state border, as well as intentional illegal crossing of the state border of the Republic of Kazakhstan through forged documents or using valid documents of third parties in violation of the established procedure –

     with the expulsion of a foreigner or stateless person outside the Republic of Kazakhstan, a fine in the amount of up to two thousand monthly calculation indices or imprisonment for a period of up to three years is punishable.

     1-1. the following:

     1) a group of people, committed by a group of people by prior collusion;

     2) made several times;

     3) the same actions committed by a person in respect of whom a ban (temporary restriction) on entry into the Republic of Kazakhstan or departure outside the Republic of Kazakhstan is established –

     with the expulsion of a foreigner or stateless person outside the Republic of Kazakhstan, a fine in the amount of up to three thousand monthly calculation indices or imprisonment for a period of up to four years is punishable.

     2. actions provided for in the first or parts 1-1 of this article, committed by a criminal group or committed with the use of force or with the threat of its use –

     a foreigner or stateless person is punished with imprisonment for a period of four to seven years with expulsion outside the Republic of Kazakhstan.
