Article 4. The procedure for election to the post of Commissioner for Human Rights in the Republic of Kazakhstan of the Constitutional Law on the Commissioner for Human Rights in the Republic of Kazakhstan
1. The Commissioner for Human Rights in the Republic of Kazakhstan is elected for a five-year term by the Senate of the Parliament of the Republic of Kazakhstan on the proposal of the President of the Republic of Kazakhstan.
2. A person elected to the post of Commissioner for Human Rights in the Republic of Kazakhstan must meet the following requirements:
1) have the citizenship of the Republic of Kazakhstan and permanently reside in its territory for the last ten years;
2) have a university degree;
3) have at least five years of experience in protecting human and civil rights and freedoms;
4) be at least thirty years old;
5) be fluent in the official language;
6) be capable.
3. Upon assuming office, the Commissioner for Human Rights in the Republic of Kazakhstan takes the following oath::
"Assuming the post of Commissioner for Human Rights in the Republic of Kazakhstan, I solemnly swear to honestly and conscientiously protect human and civil rights and freedoms and perform my duties, guided by the Constitution of the Republic of Kazakhstan, other legislation of the Republic of Kazakhstan, as well as justice and conscience. I undertake to act independently, impartially, and objectively in the interests of human and civil rights and freedoms."

This Constitutional Law defines the legal status and organization of the activities of the Commissioner for Human Rights in the Republic of Kazakhstan.
