Article 401. Other issues to be resolved in the operative part of the verdict of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan
In addition to the issues listed in Articles 398 and 400 of this Code, the operative part of both the indictment and the acquittal must contain:
1) a decision on a civil claim;
2) resolving the issue of physical evidence;
3) the decision on the distribution of procedural costs;
4) an indication of the procedure and time for appealing or reviewing the verdict at the request of the prosecutor;
5) the decision on the cancellation, application, modification or continuation of security measures in respect of protected persons;
6) a decision to cancel or maintain measures to ensure confiscation, as well as measures to secure a civil claim, if such measures have been taken.
The operative part of the conviction should also contain a decision on the recovery of compulsory payments to the Compensation Fund for Victims, their amounts and a decision on recourse claims against the guilty person for the return of money paid as compensation to the victim from the specified Fund.
When passing an acquittal, the court draws up a notice explaining the procedure for compensation for damage caused by unlawful criminal prosecution, which is handed over to the acquitted person after the verdict is announced.
