1. When performing international flights in the airspace of the Republic of Kazakhstan of national aircraft and aircraft of foreign states, general provisions governing the conduct of flights and the operation of aircraft in accordance with this Law apply.

2. International flights in the airspace of the Republic of Kazakhstan are carried out on international air routes, except for cases when the air traffic services authority has issued permission to fly outside the air route.

The procedure for opening air routes for international aircraft flights is determined by the Rules for the Use of the Airspace of the Republic of Kazakhstan.

The crossing of the State Border of the Republic of Kazakhstan in the airspace is performed by aircraft at the points where it intersects with international routes or along air corridors specially designated for these purposes in accordance with the procedure established by the Rules for the Use of the Airspace of the Republic of Kazakhstan.

3. In coordination with the authorized bodies in the fields of civil and state aviation, it is allowed to perform international flights on domestic air routes, flight routes and off-air routes.

4. An exception to the procedure for crossing the State Border of the Republic of Kazakhstan established by the Rules for the Use of the Airspace of the Republic of Kazakhstan is allowed in the following cases::

1) natural disaster, disaster, accident, emergency situation on an aircraft and in other cases threatening the life or health of people;

2) provided for by international treaties ratified by the Republic of Kazakhstan;

3) obtaining a permit issued in accordance with the procedure established by the Rules for the Use of the Airspace of the Republic of Kazakhstan.

5. For the purposes of international flights, a geodetic reference system conforming to the standards of the International Civil Aviation Organization (ICAO) is used as a geodetic reference system in the horizontal plane.

6. The departure of aircraft from the territory of the Republic of Kazakhstan, as well as their landing after takeoff on the territory of the Republic of Kazakhstan, is carried out at airfields open for international flights.

7. All aircraft, their crews and passengers arriving in and departing from the territory of the Republic of Kazakhstan or following in transit, as well as their property imported into or exported from the territory of the Republic of Kazakhstan, are subject to passport, customs, currency, sanitary and epidemiological rules and regulations established by the legislation of the Republic of Kazakhstan..

8. Certificates of aviation personnel and ship's documents on board civil aircraft of foreign countries are recognized as valid in the territory of the Republic of Kazakhstan if they comply with the standards of the International Civil Aviation Organization (ICAO). In case of lease, chartering (charter) or exchange of an aircraft, certificates of aviation personnel, ship's documents on board civil aircraft of foreign states, issued under agreements between foreign states, are recognized as valid on the territory of the Republic of Kazakhstan.

This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
