Article 445. Violation of the rules of protection of the State Border of the Republic of Kazakhstan  The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1. Violation of the rules for the protection of the State Border of the Republic of Kazakhstan, including at checkpoints, by a person who is part of a border patrol unit or performs other duties for the protection of the State Border, if this act entailed or could have entailed significant harm to the interests of state security., –

     is punishable by a fine in the amount of up to two thousand monthly calculation indices, or correctional labor in the same amount, or restriction of liberty for up to three years, or imprisonment for the same term.

     2. The same act that entailed grave consequences or was committed by a group of persons by prior agreement., –

     is punishable by imprisonment for a term of up to seven years.

     Note. A serviceman who has committed an act provided for in the first part of this article for the first time may be released from criminal liability under mitigating circumstances.
