Article 44-1. Decisions of the Judicial Jury of the Constitutional Law on the Judicial System and the Status of Judges of the Republic of Kazakhstan

     1. Based on the results of the consideration of the disciplinary case, the Judicial Jury makes one of the following decisions::

     1) the imposition of a disciplinary penalty provided for in paragraph 1 of Article 40 of this Constitutional Law;

     2) termination of disciplinary proceedings.

     2. The decision of the Judicial Jury is the basis for consideration by the Supreme Judicial Council of the issue of dismissal of the chairman, the chairman of the judicial board and the judge from their posts.

     3. The decision of the Judicial Jury may be appealed by a judge to the Supreme Judicial Council.

     By the Normative Resolution of the Constitutional Court of the Republic of Kazakhstan dated 04/21/2023 No. 10-NP, paragraph 3 of Article 44-1 of this Constitutional Law of the Republic of Kazakhstan is recognized as corresponding to paragraph 2 of Article 13 of the Constitution of the Republic of Kazakhstan.

     4. The refusal of the Supreme Judicial Council to make a recommendation on the dismissal of the chairman of the court, the chairman of the judicial Board and the judge from their posts, or the decision of the Supreme Judicial Council on the unreasonableness of imposing any disciplinary penalty on the judge, cancels the decision made by the Judicial Jury, and the disciplinary case is sent for reconsideration.

     In case of cancellation of the decision of the Judicial Jury, the Supreme Judicial Council has the right to recommend to the Judicial Jury to apply other disciplinary punishment provided for in paragraph 1 of Article 40 of this Constitutional Law, or to terminate disciplinary proceedings against the judge.
