Article 44. Pricing in construction of the Building Code of the Republic of Kazakhstan
1. Pricing in construction is the process of forming the estimated cost of construction at the stages of developing pre–design documentation and a construction project, as well as forming the contractual price of construction at the stages of conducting a tender for contract work and services, including the construction process of a construction facility.
2. The estimated cost of construction is determined using estimated regulatory documents to generate funds for the implementation of public investments.
3. In cases not provided for by paragraph 2 of this article, the estimated cost of construction is determined using estimated regulatory documents, if this is provided for by the legislation of the Republic of Kazakhstan or the contract.
4. The estimated cost of construction is used to form the maximum contract price for the construction of new and (or) modification (expansion, modernization, technical re-equipment, reconstruction, restoration, major repairs) of existing buildings, structures and their complexes, communications, as well as for the conservation and post-modernization of the construction site.
5. The estimated normative documents used in determining the estimated cost of construction are not subject to application in the execution of construction contracts.
6. Monitoring of prices (tariffs, costs) in construction is carried out in order to provide information on prices (tariffs, costs) in construction, as well as to implement the provisions of regulatory documents on pricing in construction.
7. The contract price of construction is determined in accordance with the civil legislation of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan on public procurement, procurement of certain entities of the quasi-public sector, state property, as well as in accordance with international treaties of the Republic of Kazakhstan within the framework of investment projects financed by international organizations of which the Republic of Kazakhstan is a member.
8. The estimated cost of construction and the contractual price of construction in respect of construction facilities located outside the territory of the Republic of Kazakhstan and financed with public investment are determined in accordance with the procedure determined by the Government of the Republic of Kazakhstan.
9. Regulatory documents on pricing in construction should ensure:
1) planning of construction costs at the expense of public investments;
2) the reliability of the estimated cost of construction as part of the pre-design documentation and construction projects at the expense of public investments.
10. Measures to implement the provisions of regulatory documents on pricing in construction include:
1) analysis and updating of current estimates;
2) development of estimated standards for work in construction, taking into account the development of efficient construction production technologies;
3) updating estimated regulatory documents based on monitoring and processing current prices for building materials, products, structures, and equipment.
