Article 44. Restriction of freedom of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1. Restriction of freedom consists in establishing probation control over a convicted person for a period of six months to seven years and engaging him in forced labor for one hundred hours annually during the entire term of serving the sentence. Restriction of freedom is served at the place of residence of the convicted person without isolation from society. Forced labor is organized by local executive bodies in public places and is served no more than four hours a day. Convicts who have a permanent place of work or are employed in studies, minors, pregnant women, women who have or are raising a minor child under the age of three, men who are raising a minor child under the age of three alone, women aged fifty-eight and over, men aged sixty are not involved in forced labor. persons with disabilities of the first or second group, as well as convicted persons whose sentence has been commuted to restriction of liberty for a period of less than six months.

     2. Probation control is carried out by an authorized state body and, by court decision, includes the performance of duties by the convicted person.: do not change permanent place of residence, work, or study without notifying the authorized state body responsible for monitoring the behavior of the convicted person; do not visit certain places; undergo treatment for mental and behavioral disorders (diseases) related to the use of psychoactive substances, sexually transmitted diseases; do not use psychoactive substances for non-medical purposes; if there is no permanent job or study within a month, register with the local employment agency as unemployed; do not leave home at a time determined by the court; provide financial support to the family; other duties that contribute to correcting the convicted person and preventing him from committing new criminal offenses.

     3. In case of malicious evasion from serving the restriction of freedom, his unserved term is replaced by imprisonment at the rate of one day of imprisonment for one day of restriction of freedom.

     4. If a more lenient punishment is imposed than is provided for this criminal offense, if a punishment is imposed for an unfinished crime, as well as if the punishment is commuted, the term of restriction of liberty may be lower than the lower limit established by this article.
