Article 441. Unauthorized abandonment of a unit or place of service of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1 Unauthorized abandonment of a unit or place of service, as well as failure to appear on time without valid reasons for service, committed in peacetime, if the unauthorized absence lasted for more than one month., –

     are punishable by a fine in the amount of up to two thousand monthly calculation indices, or correctional labor in the same amount, or restriction of liberty for up to three years, or imprisonment for the same term.

2 Unauthorized abandonment of a unit or place of service, committed with a weapon entrusted to the service, or by a group of persons or a group of persons by prior agreement, if the unauthorized absence lasted for more than one day, –

     is punishable by imprisonment for a term of up to five years.

3 Unauthorized abandonment of a unit or place of service, committed in a combat situation or a state of emergency, if the unauthorized absence lasted for more than one day., –

     is punishable by imprisonment for a term of five to ten years.

4 Unauthorized abandonment of a unit or place of service in wartime, regardless of the duration –

     is punishable by imprisonment for a term of ten to fifteen years.
