Article 442. Desertion The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1 Desertion, that is, unauthorized abandonment of a unit or place of service for the purpose of evading military service, as well as failure to appear for the same purpose for service, –
is punishable by imprisonment for a term of up to five years.
2 Desertion with a weapon entrusted to the service, as well as desertion committed by a group of persons by prior agreement, –
are punishable by imprisonment for a term of three to seven years.
3 The acts provided for in the first or second parts of this Article, committed in a combat situation or in a state of emergency, –
are punishable by imprisonment for a term of ten to twenty years or by life imprisonment.
4 The acts provided for in the first or second parts of this Article, committed in wartime, –
are punishable by imprisonment for a term of ten to twenty years or by life imprisonment.
