Article 45. State registration of aircraft, rights to them, registration and accounting of unmanned aircraft systems The Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities

     1. State-owned aircraft are subject to state registration in the Register of State Aviation Aircraft of the Republic of Kazakhstan in accordance with the Rules for Registration of State Aviation Aircraft of the Republic of Kazakhstan.

     The authorized body in the field of state aviation issues a notification on the state registration of the aircraft in the Register of State Aviation Aircraft to the owner of the state aircraft.

      2. Civil aircraft are subject to state registration in the State Register of Civil Aircraft of the Republic of Kazakhstan in accordance with the Rules of State Registration of Civil aircraft of the Republic of Kazakhstan and the rights to them, approved by the authorized body in the field of civil aviation.  

      A civil aircraft is registered in the State Register of Civil Aircraft of the Republic of Kazakhstan at the request of the owner or with the consent of the owner or its operator only if:  

      1) the aircraft is not registered in another country;  

      2) the owner or operator of an aircraft is an individual or a legal entity of the Republic of Kazakhstan;  

     2-1) the owner or operator of an aircraft is not a person included in the list of organizations and persons associated with the financing of the proliferation of weapons of mass destruction, and (or) in the list of organizations and persons associated with the financing of terrorism and extremism, in accordance with the legislation of the Republic of Kazakhstan, with the exception of an aircraft confiscated and (or) recovered by a court decision;

     3) a type certificate or other similar document has been issued or recognized as valid by an authorized organization in the field of civil aviation;

     4) the calendar period of operation of aircraft intended for cargo transportation (the period calculated from the date of release of the aircraft to the day of registration) does not exceed twenty-five years;

     5) the resource of an aircraft intended for cargo transportation, calculated by the number of flight cycles and by the hour, is not more than two thirds of the established factory resource (with official confirmation from the manufacturer or the design bureau);

      6) the availability of equipment providing data transmission on the condition and location of the aircraft intended for cargo transportation via terrestrial and satellite channels.  

      The operator (owner) of a registered civil aircraft is issued a certificate of state registration of a civil aircraft by an authorized organization in the field of civil aviation.  

     An aircraft included in the State Register of Civil Aircraft of the Republic of Kazakhstan must comply with the airworthiness standards of civil aircraft of the Republic of Kazakhstan and the requirements of the operational and technical documentation defining airworthiness.

     2-1. An authorized organization in the field of civil aviation refuses to register a civil aircraft if the aircraft does not meet the airworthiness requirements.

     2-2. From the moment of entry into the State Register of Civil Aircraft of the Republic of Kazakhstan, a civil aircraft acquires the nationality of the Republic of Kazakhstan.

     The certificate of state registration is on board the aircraft.

     3. The rights to civil aircraft owned by individuals or legal entities of the Republic of Kazakhstan, as well as irrevocable powers, are subject to registration by an authorized organization in the field of civil aviation in the State Register of Civil Aircraft of the Republic of Kazakhstan.

     4. Excluded by the Law of the Republic of Kazakhstan dated 05/10/2017 No. 64-VI (effective ten calendar days after the date of its first official publication).  

     5. Experimental aircraft are registered with an authorized organization in the field of civil aviation.

     6. From the moment of acquisition of ownership rights for the purpose of operation, unmanned aircraft systems are subject to accounting or registration with an authorized organization in the field of civil aviation in accordance with the procedure established by the rules of state registration of civil aircraft of the Republic of Kazakhstan and rights to them, or an authorized body in the field of state aviation in accordance with the procedure established by the rules of registration of state aviation aircraft of the Republic of Kazakhstan.

     The categories of unmanned aircraft systems subject to accounting or registration are determined by the rules of state registration of civil aircraft of the Republic of Kazakhstan and the rights to them or the rules of registration of aircraft of the State aviation of the Republic of Kazakhstan.

     Persons who purchase unmanned aircraft systems for the purpose of operation apply for registration or registration with an authorized organization in the field of civil aviation.

     7. Information about registered civil aircraft in the State Register of Civil Aircraft of the Republic of Kazakhstan, as well as about unmanned aircraft systems registered or registered in the register of unmanned aircraft systems of civil aviation of the Republic of Kazakhstan, is transmitted to the authorized body in the field of state aviation.

     This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
