Article 46-2. Assessment of the Law on Law Enforcement Service - Excluded by the Law of the Republic of Kazakhstan.

Article 46-2. Assessment of the Law on Law Enforcement Service - Excluded by the Law of the Republic of Kazakhstan.

     1. To determine the effectiveness and quality of the work of employees, an assessment of their activities is carried out.

     2. The assessment of activities is carried out annually at the end of the calendar year.

     3. The employee's performance is evaluated by the direct supervisor.

     If the immediate supervisor has been in office for less than six months, the assessment is carried out by a higher-level supervisor.

     4. The assessment of the activity is not carried out in relation to:

     1) a person during his probation period;

      2) employees who do not serve in positions of a law enforcement agency in accordance with Article 44 of this Law;

     3) employees who have been in office for less than six months, if the appointment to a new position has led to a change in job responsibilities;

     4) employees who have at least twenty years of service in law enforcement agencies.

     The assessment of the activities of the head of a law enforcement agency and his deputies is carried out by an authorized person (body) designated by the President of the Republic of Kazakhstan.

     5. The assessment of an employee's performance consists of an assessment of the employee's achievement of official goals and objectives in accordance with official duties.

     6. The results of employee performance evaluation are set on a scale with the following values: "highly effective", "efficient", "low-efficiency" and "ineffective".

     7. The results of the performance assessment are included in the assessment sheet in a form approved by a joint order of the heads of law enforcement agencies.

     The assessment sheet contains the name of the activities formed taking into account job responsibilities and reflecting the effectiveness of work in a particular area (line of activity).

     When evaluating a manager, the average performance of the employees subordinate to him is taken into account.

      8. An individual professional development plan is drawn up for employees with values of performance evaluation results "low-efficiency" and "ineffective" by the person who conducted the assessment.  

     An individual employee's professional development plan defines priority areas and recommendations aimed at improving the employee's efficiency and professional and personal growth for a certain period of time (until the next performance assessment).

     9. The results of the evaluation of the employee's performance are the basis for certification in the following cases::

     1) the employee receives an "ineffective" rating;

      2) the employee receives a "low performance" rating for two consecutive years.  

     The certification of such employees is carried out within six months from the date of the performance assessment.

     At the same time, the period of attestation is suspended for the period of appeal of the results of the assessment of activities.

     10. The person who conducted the assessment shall inform the employee in writing of the assessment results, as well as an individual professional development plan, within three working days from the date of the assessment.

     11. The employee has the right to appeal the results of the assessment to the head of the law enforcement agency or the authorized head within ten working days from the date of familiarization and (or) in court.

 

 

The Law of the Republic of Kazakhstan dated January 6, 2011 No. 380-IV.

     This Law regulates public relations related to admission to the law enforcement service of the Republic of Kazakhstan, its passage and termination, and also defines the legal status (status), financial support and social protection of law enforcement officers of the Republic of Kazakhstan.
