Article 46-8. The rights and obligations of persons subjected to administrative arrest, foreigners and stateless persons subject to forced expulsion, held in special reception facilities, temporary detention facilities, and guardhouses of the Law On the Procedure and Conditions of Detention of Persons in Special Institutions, Special Premises Providing Temporary Isolation from Society

     1. Persons subjected to administrative arrest, foreigners and stateless persons subject to compulsory expulsion, held in special reception facilities, distribution centers, temporary detention facilities, have the right:

     1) to receive information about their rights and obligations, the regime of detention in a special receiver, receiver-distributor, temporary detention facility, the procedure for submitting proposals, applications and complaints;

     2) personal safety during the stay in a special receiver, receiver-distributor, temporary detention facility;

     3) receive material and household and medical services in accordance with the standards approved by the Internal Regulations in a special reception;

     4) receive letters, parcels, parcels and transfers;

     5) an eight-hour nap at night;

     6) for a daily walk of at least two hours a day;

     7) to perform religious rites – subject to compliance with the Rules of internal order in a special receiver, receiver-distributor, temporary detention facility and the rights of others.;

     8) apply to the administration of a special receiver, receiver-distributor, temporary detention facility, prosecutor's office, court on issues of violation of their rights and legitimate interests.

     2. Persons subjected to administrative arrest, foreigners and stateless persons subject to forced expulsion, placed in special reception facilities, distribution facilities, temporary detention facilities, are required to comply with the Internal Regulations in a special reception facility, distribution facility, temporary detention facility.

     3. Military personnel subjected to administrative arrest held in guardhouses shall be subject to the provisions of paragraphs 1 and 2 of this Article in accordance with the procedure for military personnel serving administrative arrest in the guardhouse.

The Law of the Republic of Kazakhstan dated March 30, 1999 No. 353-I.

     This Law defines the legal basis for the activities of special institutions and special premises that legally provide temporary isolation from society, as well as establishes the rights and obligations of the persons contained therein.
