Article 47. Employee certification The Law on Law Enforcement Service
1. The certification of employees is a periodic procedure to determine the level of their professional training, legal culture and ability to work with citizens.
2. The main evaluation criterion for certification is the employee's compliance with his position, taking into account the assessment of his personal and professional qualities, and the results of his official activities.
3. Employees are certified after each subsequent three years of continuous service in the law enforcement system. In this case, the certification must be carried out no later than six months from the date of the specified period.
In cases where employees subject to certification are appointed to new positions, they are certified one year after their appointment. When appointing to equivalent positions, unless this has led to changes in functional responsibilities, this period is not taken into account, with the exception of employees undergoing unscheduled certification.
Upon passing the certification, service in the law enforcement system is considered continuous when no more than three months have passed from the date of the employee's dismissal from service in the law enforcement system to the date of his admission to service in the law enforcement system, provided that during the specified period he has no employment relations with other legal entities (with the exception of state bodies) and individuals.

3-2. An employee who studies in educational organizations as part of a state order for the training of civil servants is certified upon graduation, but not earlier than one year after being appointed to a position in a law enforcement agency.
Attestation of employees seconded to government agencies is carried out in accordance with the procedure established for employees of relevant government agencies, and employees seconded to international organizations are certified after returning from an international organization, but not earlier than one year after taking up a position in a law enforcement agency.
3-3. During the attestation period, employees may not be appointed to positions or reassigned until the attestation is completed, with the exception of transfers in connection with organizational and staff events, admission to study at law enforcement education organizations, secondment to government agencies and international organizations.
4. The head of a law enforcement agency and his deputies, as well as employees with at least twenty years of service in law enforcement or special government agencies or military service, are not subject to certification, with the exception of employees subject to unscheduled certification.
Employees are not subject to certification during their pregnancy and while on leave, as provided for in Article 77 of this Law. They are certified after entering the service no earlier than one year later.
5. The certification includes a number of successive stages:
1) preparation for certification;
2) passing the established standards for determining professional aptitude, with the exception of employees of the prosecutor's office;
3) computer testing of an employee subject to certification for knowledge of the legislation of the Republic of Kazakhstan, the Kazakh language and logical thinking;
3-1) Is excluded by the Law of the Republic of Kazakhstan dated 07/11/2022 No. 136-VII (effective sixty calendar days after the date of its first official publication).
3-2) conducting psychological and sociological research of the employee;
3-3) conducting a polygraph examination by decision of the head of the law enforcement agency;
4) an interview with an employee conducted by the attestation commission;
5) making a decision of the attestation commission.

This Law regulates public relations related to admission to the law enforcement service of the Republic of Kazakhstan, its passage and termination, and also defines the legal status (status), financial support and social protection of law enforcement officers of the Republic of Kazakhstan.
