1. An electronic digital signature is a digital record (a set of digital data) created using the private key of an electronic digital signature and electronic digital signature tools, confirming the authenticity of an electronic document, its affiliation and the immutability of its content.

2. An electronic digital signature is equivalent to a handwritten signature of the signatory and has equal legal force provided that the following conditions are met::

1) the authenticity of the electronic digital signature has been confirmed using a public key with an electronic digital signature public key certificate;

2) the person who signed the electronic document lawfully owns the private key of the electronic digital signature;

3) an electronic digital signature is used in accordance with the information specified in the electronic digital signature public key certificate.;

4) the electronic digital signature public key certificate is issued by a certification center accredited in the Republic of Kazakhstan or a foreign certification center registered with a trusted third party in the Republic of Kazakhstan.

3. An electronic digital signature created using the certificate of the public key of the electronic digital signature of a digital object is equivalent to the electronic digital signature of the owner of such a digital object. The use of such an electronic digital signature is allowed for the automatic signing of electronic documents of the same type that do not contain an expression of will aimed at establishing, changing or terminating civil rights and obligations.
