The authorized body in the field of science and higher education performs the following powers:

1) ensures the observance of the constitutional rights and freedoms of citizens in the field of education;

2) formulates and implements a unified state policy in the field of higher and postgraduate education, carries out intersectoral coordination, develops and implements international programs in the field of higher and postgraduate education and science;

3) provides objective information to society and the state about the state of the education system and the effectiveness of its activities by preparing and publishing an annual national report on the state of education development in the field of higher and postgraduate education;

4) carries out educational monitoring and information support of the educational management system, approves the rules for the organization and functioning of informatization facilities in the field of education;

5) approves the rules for monitoring the admission of students to organizations of higher and (or) postgraduate education in educational programs;

6) issues to legal entities a license and (or) an appendix to the license to engage in educational activities for the provision of:

higher education in the fields of personnel training and forms of education;

postgraduate education in the areas of personnel training and forms of education;

spiritual education;

7) establishes the procedure for educational monitoring;

8) conducts state certification of organizations of higher and (or) postgraduate education, regardless of their forms of ownership and departmental subordination, with the exception of the Academy of Justice, which implement educational programs of higher and (or) postgraduate education in military and special educational institutions;

9) approves the standard rules for admission to educational institutions that implement higher and postgraduate education programs;

10) approves the standard rules for the activities of organizations of higher and postgraduate education;

11) approves the classifier of personnel training areas in cooperation with interested central executive bodies, employers and other social partners;

12) carries out the procedure of apostillation of official documents originating from organizations of higher and (or) postgraduate education;

13) directs and coordinates the conduct of educational, methodological and scientific-methodical work, approves the rules for the organization and implementation of educational, methodological and scientific-methodical work in educational organizations, with the exception of educational organizations in the field of culture, the rules for the organization of the educational process on credit technology of education, as well as the requirements for educational organizations to provide distance learning and the rules for organizing the educational process in distance learning and in the form of online learning in educational programs of higher and (or) postgraduate education.;

14) approves the charters of subordinate educational organizations, with the exception of cases provided for by the laws of the Republic of Kazakhstan;

15) exercises state control over the implementation of the legislation of the Republic of Kazakhstan and regulatory legal acts in the field of education, state mandatory standards of education in organizations of higher and (or) postgraduate education, regardless of the forms of ownership and departmental subordination, as well as budgetary and financial discipline in subordinate organizations in accordance with the legislation of the Republic of Kazakhstan;

16) approves, together with the authorized labor body, the rules for the appointment and dismissal of the first heads and teachers of state educational organizations;

17) conducts negotiations with foreign partners and signs, within its competence, international treaties (agreements) and programs in the field of higher and (or) postgraduate education, as well as scientific activities;

18) approves the rules for placing a state order to provide students, undergraduates and doctoral students with places in dormitories;

19) issues binding written instructions on the elimination of identified violations of the legislation of the Republic of Kazakhstan in the field of higher and (or) postgraduate education within the time limits specified in the instruction;

20) approves the nomenclature of types of educational organizations in the field of higher and (or) postgraduate education;

21) receives information contained in the national registers of identification numbers in accordance with the legislation of the Republic of Kazakhstan;

22) approves the rules for the organization of dual education in coordination with interested government agencies.;

23) approves the structure and rules for the development of a program for the organization of higher and (or) postgraduate education;

24) approves the rules for the selection of applicants for participation in scholarship programs;

25) approves the list of types and types of organizations of higher and (or) postgraduate education in which per capita regulatory financing is implemented;

26) approves the rules for awarding an educational grant to pay for higher or postgraduate education with the award of a bachelor's or master's degree;

27) establishes state nominal scholarships;

28) determines the procedure for sending a specialist to work, reimbursing expenses incurred from budgetary funds, granting the right to self-employment, relieving or terminating the obligation to work for citizens of the Republic of Kazakhstan specified in paragraph 17 of Article 47 of this Law who studied on the basis of a state educational order;

29) determines the organization (administrator) that implements a set of measures for international training, retraining and advanced training programs for personnel abroad, including the Bolashak International Scholarship.

30) jointly with the authorized body in the field of education, develops and approves rules for the recognition of learning outcomes obtained through non-formal education, as well as the results of recognition of professional qualifications;

31) develops and approves a professional standard for teachers (faculty) of higher and (or) postgraduate education organizations.

32) develops and approves, together with the authorized body in the field of education, rules for the use of payments of earmarked savings from the unified accumulative pension fund for the purpose of paying for education in accordance with the legislation of the Republic of Kazakhstan.

The powers of the authorized body in the field of science and higher education provided for in sub-paragraphs 4), 5), 7), 9), 10), 11), 13), 16), 18), 20), 22), 23), 24) and 25) of the first part of this article, do not apply to the military, special educational institutions and the Academy of Justice.

The Law of the Republic of Kazakhstan dated July 27, 2007 No. 319-III.

This Law regulates public relations in the field of education, defines the basic principles of state policy in this field and is aimed at ensuring the constitutional right of citizens of the Republic of Kazakhstan, as well as foreigners and stateless persons permanently residing in the Republic of Kazakhstan, to education.
