Article 50. Norms for the provision of land plots of the Land Code of the Republic of Kazakhstan

Article 50. Norms for the provision of land plots of the Land Code of the Republic of Kazakhstan

     1. The size of land plots provided to citizens and legal entities for non-agricultural purposes is determined according to the norms of land allocation for these types of activities approved in accordance with the procedure established by the legislation of the Republic of Kazakhstan or in accordance with architectural, urban planning and (or) construction documentation.  

     2. Land plots, with the exception of those included in the list of land plots offered for sale at auctions in accordance with paragraph 1 of Article 48 of this Code, are provided to citizens of the Republic of Kazakhstan free of charge for private ownership in the following amounts:  

     1) for personal subsidiary farming (including household and field plots) in rural areas - 0.25 hectares on non-irrigated and 0.15 hectares on irrigated lands;  

     2) for individual housing construction - 0.10 hectares;  

     3) for gardening, as well as cottage construction - 0.12 hectares.

     Repeated free provision of land plots for these purposes is not allowed, except in the case specified in paragraph 4 of Article 94 of this Code.  

     The provision of land plots free of charge to private ownership for personal subsidiary farming (household allotment) and individual housing construction is carried out after the development of land plots. The provision of land plots for the specified purposes for the period of development is carried out on the right of temporary paid land use (lease) with the establishment of conditions and deadlines for the development of such land plots in accordance with Article 92 of this Code.

     If there is vacant land on the territory of rural settlements, land plots for individual housing construction and personal subsidiary farming are provided in a single array within the limits of the norms of land plots provided for these purposes.

     2-1. Land plots for gardening are provided to citizens of the Republic of Kazakhstan on the right of temporary gratuitous land use in the amount of no more than 1 hectare.

     3. The maximum size of the land plots listed in paragraph 2 of this article, which may be privately owned, shall be established by joint decisions of the representative and executive bodies of regions, cities of republican significance, and the capital, depending on local conditions and specifics.  

     4. The Government of the Republic of Kazakhstan, on the basis of a joint proposal from the representative and executive bodies of regions, cities of republican significance, and the capital, establishes the maximum (maximum) sizes of agricultural land plots by type of agricultural land within the republic and one administrative district (city), regions that may be located:

     on the right of private ownership of a citizen of the Republic of Kazakhstan for farming or farming, a non-governmental legal entity of the Republic of Kazakhstan without foreign participation and its affiliated companies for agricultural production;

     on the right of temporary land use from a citizen of the Republic of Kazakhstan for farming or farming, a non-governmental legal entity of the Republic of Kazakhstan without foreign participation and its affiliated persons for agricultural production.

     Provision of land plots for the purposes specified in this paragraph in amounts exceeding the maximum size is not allowed.

     5. For the purpose of rational use of agricultural land plots, joint decisions of regional representative and executive bodies establish minimum sizes of agricultural land plots depending on local conditions and the specifics of the use of these lands provided for ownership or land use.
