Article 51. The rights, duties and responsibilities of a teacher engaged in professional activity in the organization of higher and (or) postgraduate education The Law on Education

Article 51. The rights, duties and responsibilities of a teacher engaged in professional activity in the organization of higher and (or) postgraduate education The Law on Education

 

     1. Persons are not allowed to participate in the professional activity of a teacher of an organization of higher and (or) postgraduate education.:

     1) deprived of the right to carry out the professional activity of a teacher in accordance with a court verdict that has entered into legal force;

     2) recognized as legally incompetent or with limited legal capacity in accordance with the procedure established by the laws of the Republic of Kazakhstan;

     3) having medical contraindications, as well as with mental and behavioral disorders (diseases), including those related to the use of psychoactive substances, registered with healthcare organizations;

     4) those who do not have documents on higher or postgraduate education;

     5) on the basis of other restrictions stipulated by the Labor Code of the Republic of Kazakhstan.

     2. A teacher who carries out professional activities in the organization of higher and (or) postgraduate education has the right to:

     1) engaging in teaching activities with the provision of conditions for professional activity;

     2) engaging in scientific research, experimental work, and the introduction of new methods and technologies into teaching practice;

     3) individual teaching activities;

     4) free choice of methods and forms of organization of pedagogical activity, subject to compliance with the requirements of the state mandatory standard of the appropriate level of education;

     5) participation in the work of the collegial governing bodies of the educational organization;

     6) professional development at least once every five years lasting no more than four months;

     7) excluded by the Law of the Republic of Kazakhstan dated December 27, 2019 No. 294-VI (effective ten calendar days after the date of its first official publication);  

     8) moral and material encouragement for success in teaching in the form of state awards, honorary titles, prizes and nominal scholarships;

     9) protection of one's professional honor and dignity;

     10) deferral from conscription;

     11) sabbatical leave to engage in scientific activities while maintaining teaching experience;

     12) appealing orders and orders of the administration of the educational organization;

     13) respect for honor and dignity on the part of students, pupils and their parents or other legal representatives.

     3. A teacher who carries out professional activities in the organization of higher and (or) postgraduate education is obliged to:

     1) possess relevant theoretical and practical knowledge and teaching skills in the field of their professional competence;

     2) to ensure the quality of educational services provided in accordance with the requirements of the state mandatory education standards;

     3) to educate students in the spirit of high morality, respect for parents, ethno-cultural values, and respect for the outside world;

     4) develop students' life skills, competence, independence, and creative abilities;

     5) constantly improve their professional skills, intellectual, creative and general scientific level;

     6) excluded by the Law of the Republic of Kazakhstan dated December 27, 2019 No. 294-VI (effective ten calendar days after the date of its first official publication);  

     7) follow the rules of pedagogical ethics;

     8) respect the honor and dignity of students, pupils and their parents or other legal representatives;

     9) immediately inform law enforcement agencies about the facts of minors committing or in relation to them actions (inaction) containing signs of a criminal or administrative offense in educational organizations, as well as about facts that have become known to him in connection with professional activities outside educational organizations;

     10) within one working day from the moment of identification of a child in need of special social services, inform the authorities of the system of prevention of offenses, neglect and homelessness among minors.

     For violation of duties and commission of misconduct discrediting the title of a teacher, a teacher engaged in professional activity in an organization of higher and (or) postgraduate education may be held liable in accordance with the laws of the Republic of Kazakhstan.

     4. It is not allowed to involve teachers engaged in professional activities in organizations of higher and (or) postgraduate education in types of work not related to the performance of their professional duties, except in cases provided for by the laws of the Republic of Kazakhstan.

      5. Teachers engaged in professional activities in organizations of higher and (or) postgraduate education are prohibited from using the educational process for the purposes of political agitation, religious propaganda or to encourage students to take actions contrary to the Constitution of the Republic of Kazakhstan and the legislation of the Republic of Kazakhstan.1. 2-1) to teach students the methods of scientific research and academic writing and apply them in the field under study;

     3) to educate students in the spirit of high morality, respect for parents, ethno-cultural values, and respect for the outside world;

     4) develop students' life skills, competence, independence, and creative abilities;

     5) constantly improve their professional skills, intellectual, creative and general scientific level;

     6) excluded by the Law of the Republic of Kazakhstan dated December 27, 2019 No. 294-VI (effective ten calendar days after the date of its first official publication);  

     7) observe the rules of pedagogical ethics and the principles of scientific ethics;

     8) respect the honor and dignity of students, pupils and their parents or other legal representatives;

     9) immediately inform law enforcement agencies about the facts of minors committing or in relation to them actions (inaction) containing signs of a criminal or administrative offense in educational organizations, as well as about facts that have become known to him in connection with professional activities outside educational organizations;

The Law of the Republic of Kazakhstan dated July 27, 2007 No. 319-III.

This Law regulates public relations in the field of education, defines the basic principles of state policy in this field and is aimed at ensuring the constitutional right of citizens of the Republic of Kazakhstan, as well as foreigners and stateless persons permanently residing in the Republic of Kazakhstan, to education.
