Article 57. Certification of specialists (experts) in the field of architectural, urban planning and construction activities of the Building Code of the Republic of Kazakhstan

1. Certification of specialists (experts) in the field of architectural, urban planning and construction activities is recognized as a procedure carried out by a certification center in order to assess the compliance of a candidate applying for certification with the requirements of professional standards in accordance with the procedure determined by the authorized body for architecture, urban planning and construction. Based on the results of the certification, a certificate of a specialist (expert) in the field of architectural, urban planning and construction activities established by the authorized body for architecture, urban planning and construction is issued.

The list of professions of specialists (experts) subject to certification of specialists (experts) in the field of architectural, urban planning and construction activities is determined by the authorized body for architecture, urban planning and construction.

2. A candidate applying for certification as a specialist (expert) in the field of architectural, urban planning and construction activities is an individual who meets the qualification requirements established by the authorized body for architecture, urban planning and construction, and has applied to the certification center for recognition of his professional qualifications.

3. The procedure for recognizing a specialist (expert) with relevant professional qualifications in the field of architectural, urban planning and construction activities is carried out in accordance with the procedure determined by the authorized body for architecture, urban planning and construction.

4. A certification body is recognized as a legal entity in the form of an association of individuals and (or) legal entities for the certification of specialists (experts) in the field of architectural, urban planning and construction activities.

The conclusion of an agreement with the recognized winner of the competition for the right to certify specialists (experts) and the control of its execution are carried out by the authorized body for architecture, urban planning and construction.

The term of the contract for the right to certify specialists (experts) is three years.

Certification centers are established for each individual area of work and services in the field of architectural, urban planning and construction activities.

5. A certificate of a specialist (expert) in the field of architectural, urban planning and construction activities is a standard document certifying the completion of the certification procedure and confirming professional qualifications.

The certificate of a specialist (expert) in the field of architectural, urban planning and construction activities is entered into the register of certified specialists (experts) in the field of architectural, urban planning and construction activities in accordance with the procedure determined by the authorized body for architecture, urban planning and construction.

6. The certificate of a specialist (expert) in the field of architectural, urban planning and construction activities is valid for no more than five years, depending on the list of professions in the field of architectural, urban planning and construction activities.

Termination of the certificate of a specialist (expert) in the field of architectural, urban planning and construction activities is one of the following grounds:

1) non-compliance with requirements in the field of architectural, urban planning and construction activities;

2) failure to carry out continuous practical activities within the framework of the existing certificate for two years;

3) voluntary request of the certificate holder to terminate the certificate;

4) confirmation of the fact of violation of the legislation of the Republic of Kazakhstan in the field of architectural, urban planning and construction activities and state regulatory documents.

In case of termination of the certificate of a specialist (expert) in the field of architectural, urban planning and construction activities, with the exception of the grounds provided for in subparagraphs 2) and 3) of part two of this paragraph, re-obtaining the certificate is possible after two years from the date of termination of the certificate.

7. A candidate who does not agree with the certification results has the right to appeal the certification result to the appeal commission of the certification center within three working days.

The appeal commission of the certification center considers this appeal in accordance with the rules on the assessment of professional knowledge in the field of architectural, urban planning and construction activities, approved by the certification center in coordination with the authorized body for architecture, urban planning and construction.

In case of disagreement with the decision of the appeal commission of the certification center, the candidate has the right to apply to the court.

This Code regulates public relations related to the implementation of architectural, urban planning and construction activities in the Republic of Kazakhstan, the formation of a full-fledged habitat and human activity, planning and development of settlements, interuniverse territories, ensuring the safety of construction sites at all stages of their life cycle.
