Article 57. Division of a land plot in common shared ownership (common shared land use) and allocation of a share from it of the Land Code of the Republic of Kazakhstan
1. If the participants fail to reach an agreement on the method and conditions of dividing the common land plot, each participant has the right to demand the allocation of his land share from the common land plot in kind (on the ground), except for the cases provided for in paragraph 2 of Article 62 of this Code, and in other cases established by legislative acts of the Republic Kazakhstan.
2. If the allocation of a land share in kind is not allowed by the legislative acts of the Republic of Kazakhstan or is impossible without disproportionate damage to the land plot and everything that is firmly connected with it, the allocated owner (land user) has the right to pay him the value of his land share by other participants in common shared ownership (common land use) or sell it to another person in accordance with the rules established by paragraph 2 of Article 55 of this Code, except for the case when the land share is located as part of a condominium facility.
