Article 57. Financing of courts of the Constitutional Law On the Judicial System and the Status of Judges of the Republic of Kazakhstan

     1. The financing of the Supreme Court, local and other courts of the Republic of Kazakhstan is carried out at the expense of the republican budget.

     2. The budget of the judicial system must fully ensure that the courts exercise their constitutional powers.

     The expenses of the judicial system amount to at least six and a half percent of the total amount of expenditures under the budget program 001 of all state bodies established by the republican budget for the previous fiscal year.

     3. In the event of a reduction in the total amount of expenditures under the budget program of all state bodies as a result of clarifying the republican budget, adjusting the republican budget, or sequestering, the amount of expenditures on the judicial system established by the republican budget for the relevant planning period is not subject to reduction.

     4. Expenses for the judicial system established by the republican budget for the relevant planning period are not subject to sequestration.

     If the republican budget is clarified or adjusted during the current financial year, the expenses for the judicial system established by the republican budget for the corresponding planning period are not subject to reduction.

     The limit of current administrative expenses stipulated by the Budget Code of the Republic of Kazakhstan is not set for the administrator of budget programs of the judicial system.

     5. The distribution of the budget of the judicial system by levels and areas of expenditure is approved at an expanded plenary session of the Supreme Court in accordance with the rules of procedure approved by it.

     6. The budget application of the administrator of the budget program of the judicial system is included in the draft republican budget without making changes.

     The authorized body for budget Planning, for submission to the Republican Budget Commission in accordance with the procedure established by the budget legislation of the Republic of Kazakhstan, prepares an opinion on the budget application of the administrator of the budget program of the judicial system for compliance with the budget legislation of the Republic of Kazakhstan and the correctness of calculations.

     7. The procedure for using the funds allocated from the national budget for organizing the activities of the international council is determined by the authorized body.

     8. The head of the authorized body is a member of the Republican Budget Commission, formed in accordance with the procedure provided for by the Budget Code of the Republic of Kazakhstan.
