Article 58. Decision-making by the Constitutional Court. The Constitutional Law On the Constitutional Court of the Republic of Kazakhstan

     1. The Constitutional Court makes decisions collectively.

     2. The Constitutional Court shall make a decision by a majority vote of the judges participating in the session by open voting, with the exception of the case provided for in paragraph 3 of Article 25 of this Constitutional Law.

     3. If the votes of the judges of the Constitutional Court are equally divided during the decision-making process, the vote of the Chairman of the Constitutional Court, who in all cases casts his vote last, is decisive. When the Chairman of the Constitutional Court is replaced by a corresponding judge of the Constitutional Court, this rule does not apply. In this case, a repeat vote is held with the participation of the Chairman or judge of the Constitutional Court, who did not participate in the first vote.

     4. During the session of the Constitutional Court, none of its judges participating in the session has the right to abstain or not participate in voting.

     5. The decisions adopted by the Constitutional Court, prior to their signing by the Chairman, are pre-sealed with the signatures of the judges of the Constitutional Court who participated in the voting.
