Article 59. The introduction of this Constitutional Law and related features of the activity of judges of the Constitutional Law On the Judicial System and the Status of Judges of the Republic of Kazakhstan

Article 59. The introduction of this Constitutional Law and related features of the activity of judges of the Constitutional Law On the Judicial System and the Status of Judges of the Republic of Kazakhstan

     1. This Constitutional Law shall enter into force from the date of its official publication, with the exception of paragraph 2 of Article 11, Article 13, paragraph 2 of Article 18, Article 19, Article 30 and part two of paragraph 2 of Article 36, which shall enter into force as soon as the relevant legislation is adopted, but no later than July 1, 2001.

     2. The current chairmen and judges of the courts of the Republic, appointed or elected to their posts before the entry into force of this Constitutional Law, retain their powers.

     3. The five-year term of office of the chairmen of the courts, elected or appointed to positions before the entry into force of this Constitutional Law, is calculated from the moment of election or appointment to the position.

     4. The chairmen of judicial boards of regional courts, equivalent courts and the Supreme Court of the Republic of Kazakhstan shall retain their powers until the formation of collegiums of courts of the Republic of Kazakhstan provided for by this Constitutional Law.

     5. For judges who retired between January 1, 2019 and December 31, 2021 and have not reached the retirement age established by the Law of the Republic of Kazakhstan "On Pension Provision in the Republic of Kazakhstan", the amount of the lump-sum benefit provided for in paragraph 2 of Article 35 of this Constitutional Law is determined from the amount of remuneration in effect as of January 1, 2018.

     6. Paragraph 1-1 of Article 35 of this Constitutional Law applies to persons who have terminated the powers of a judge before its enactment.
