Article 6. Competence of local representative and executive bodies in the field of education of the Law on Education

Article 6. Competence of local representative and executive bodies in the field of education of the Law on Education

     1. Local representative bodies:

     1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

     2) decide on preferential travel for students by public transport (except taxis);

     3) exercise other powers in accordance with the legislation of the Republic of Kazakhstan to ensure the rights and legitimate interests of citizens.

     2. Local executive body of the region:

     1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

     1-1) implements the state policy in the field of education;

     1-2) ensures the quality of education in state organizations of primary, basic secondary and general secondary education, including evening (shift) education, and general secondary education provided through residential type organizations (with the exception of educational organizations in correctional institutions of the penal (penitentiary) system);

     1-3) ensures the functioning of support schools (resource centers), including their interaction with small schools;

     2) ensures the quality of the provision of technical and vocational, post-secondary education;

     3) ensures the education of persons (children) with special educational needs, the creation of special conditions for them to receive education in educational institutions, accessibility of buildings, structures and premises of educational institutions in accordance with state building codes and standards, taking into account the principles of universal design and (or) reasonable accommodation;

     4) provides education for gifted children in specialized educational institutions;

     4-1) organizes the registration of children of preschool and school age, their education until they receive secondary education;

     4-2) ensures the placement of a state educational order for preschool education and training;

     5) organizes the ordering and provision of educational organizations implementing general educational programs of basic secondary, general secondary education and educational programs of technical and vocational, post-secondary education with forms of state-issued documents on education and monitors their use;

     5-1) excluded by the Law of the Republic of Kazakhstan dated 13.06.2013 No. 102-V (effective after ten calendar days after its first official publication);

     6) creates, reorganizes and liquidates, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, state educational organizations that implement general educational programs for preschool education and training, primary, basic secondary and general secondary education and additional educational programs for children, with the exception of state educational organizations that implement specialized general education and special educational programs, as well as in coordination with the authorized body in the field of education is the state educational organizations, implementing educational programs of technical and vocational, post-secondary education, specialized general education and special educational programs, children's and youth sports schools;

     6-1) provides for the construction and reconstruction of secondary education facilities at the expense of the Educational Infrastructure Support Fund in accordance with the legislation of the Republic of Kazakhstan;- Excluded by the Law of the Republic of Kazakhstan.

     6-2) provides, every five years, an accident assessment survey of state preschool organizations, organizations of secondary, technical and vocational, post-secondary and additional education (with the exception of educational organizations in correctional institutions of the penal (penitentiary) system) that have been in operation for more than thirty years, as well as an earthquake safety survey of state preschool organizations, organizations of secondary, technical and vocational, post-secondary and additional education, located in earthquake-prone regions;

     7) - 7-2) are excluded by the Law of the Republic of Kazakhstan dated 24.10.2011 No. 487-IV (effective six months after its first official publication);

     7-3) approves the state educational order for preschool education and training, the amount of parental fees;

     8) approves the state educational order for the training of personnel with higher and postgraduate education;

     8-1) places a state educational order for the training of personnel with technical and professional, post-secondary, higher and postgraduate education, taking into account the proposals of regional chambers of entrepreneurs and interested organizations;

     8-2) approves the state educational order for secondary education in state educational organizations;

     8-3) approves the state educational order for the training of personnel with technical and vocational, post-secondary education;

     8-4) approves the state educational order for additional education of children within the limits of the budget funds approved in local budgets for the relevant financial year.;

     8-5) approves and places a state educational order for special psychological and pedagogical support for children with disabilities within the limits of budget funds approved in local budgets for the relevant fiscal year;

     9) organizes the participation of students in the unified national testing;

     10) provides logistical support to state educational organizations that implement educational programs for technical and vocational, post-secondary education, as well as specialized general education and special educational programs (with the exception of educational organizations in correctional institutions of the penal system);

     10-1) supports and assists in the logistical support of state educational organizations that implement general education curricula for primary, basic secondary and general secondary education (with the exception of educational organizations in correctional institutions of the penal system);

     11) directs funds to provide financial and material assistance to students and pupils of state educational organizations of regional and district (city of regional significance) scales from families eligible for state targeted social assistance, as well as from families not receiving state targeted social assistance, in which the average per capita income is below the subsistence level, and children-orphans, children left without parental care, living in families, children from families requiring emergency assistance as a result of emergency situations, and other categories of students and pupils, determined by the collegial management body of the educational organization, in the amount of at least two percent of the budget funds allocated for the current maintenance of secondary schools and for the placement of a state educational order for secondary education in state-owned enterprises on the right of economic management.;

     12) annually, until August 1, ensures the purchase and delivery of textbooks and teaching materials on paper and electronic media for educational organizations that implement educational programs for technical and vocational education, as well as specialized general education and special educational programs based on government orders;

     12-1) annually, until August 1, organizes the purchase and delivery of textbooks and teaching materials to educational organizations located in districts (cities of regional significance) that implement general education curricula for pre-school education, and secondary education organizations in the amount projected by educational authorities for the academic year;

     13) provides education for persons (children) with special educational needs, creation of special conditions for them to receive education in educational institutions, accessibility of buildings, structures and premises of educational institutions in accordance with state building codes and standards, taking into account the principles of universal design and (or) reasonable accommodation;

     13-1) organizes, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, medical care for students and pupils of educational organizations, including those located in districts (cities of regional significance), with the exception of preschool organizations and secondary education organizations that do not belong to boarding schools;

     13-2) ensures the quality of pre-school education and training, including organizing, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, medical care in pre-school education and training organizations in urban areas, cities of regional and district significance, towns, villages, rural districts;

     14) ensures the quality of the provision of additional education for children, carried out at the regional and district (cities of regional significance) levels;

     15) ensures the quality of staff retraining and advanced training of employees of state educational organizations funded by budgetary funds;

     16) excluded by the Law of the Republic of Kazakhstan dated 09/29/2014 No. 239-V (effective ten calendar days after the date of its first official publication);

     16-1) provides examination of the mental health of children and adolescents and the provision of psychological, medical and pedagogical counseling;

17) provides rehabilitation and social adaptation of children and adolescents with developmental problems;

     18) provides state support for orphaned children and children left without parental care in accordance with the established procedure;

     18-1) provides pre-school education and training organizations, including those located in districts (cities of regional significance), and families with the necessary methodological and advisory assistance;

     19) organizes free and reduced-price meals for certain categories of students and pupils in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan;

     20) promotes the employment of persons who have graduated from educational organizations implementing educational programs of technical and vocational, post-secondary, higher and postgraduate education on the basis of a state educational order;

     20-1) annually, by April 15, submits to the authorized bodies in the field of education and health applications on the need for personnel in rural areas with subsequent employment according to the submitted applications;

     21) submits proposals to the maslikhat on preferential travel for students on public transport (except taxis);

     22) appoints and dismisses the first head of the regional education management body.;

     22-1) carries out educational monitoring;

     22-2) annually, within the established time limits, ensures the collection of statistical observation data in the informatization facilities of the authorized body in the field of education;

     23) ensures the functioning of juvenile adaptation centers and support centers for children in need of special social services;

     24) provides conditions for persons held in juvenile adaptation centers and support centers for children in need of special social services;

     24-1) provides assistance to the Boards of Trustees;

     24-2) provides high-quality personnel support to state educational organizations;

     24-3) pays the "Best Secondary Education Organization" grant to the winners of the competition – state organizations of secondary education;

     24-4) issues a permit for training in the form of an externship in organizations of basic secondary, general secondary education, educational organizations that implement specialized and special general education educational programs, as well as educational programs for technical and vocational, post-secondary education in the fields of culture and art, physical culture and sports;

     24-5) provides the material and technical base of teaching classrooms;

     24-6) Excluded by the Law of the Republic of Kazakhstan dated 05/03/2022 No. 118-VII (effective ten calendar days after the date of its first official publication).      

24-7) is excluded by the Law of the Republic of Kazakhstan dated 02/23/2024 No. 64-VIII (effective sixty calendar days after the date of its first official publication).

     24-8) ensures the quality of training of qualified workers and mid-level specialists in dual training;

     24-9) pays the grant "The best organization of technical and vocational, post–secondary education" to the winners of the competition - state organizations of technical and vocational, post-secondary education;

     24-10) provides methodological guidance to the psychological service in educational organizations, including those located in districts (cities of regional significance);

     24-11) Is excluded by the Law of the Republic of Kazakhstan dated 26.06.2021 No. 56-VII (effective ten calendar days after the date of its first official publication).

     24-12) organizes free transportation of students to the nearest school and back if there is no school in the relevant village, village, rural district.;

     24-13) rotates the first heads of state educational organizations in accordance with the rules of rotation of the first heads of state educational organizations.;

     25) exercises, in the interests of local government, other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.

     3. The local executive body of the city of republican significance and the capital:

     1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

     2) organizes the registration of children of preschool and school age, their education until they receive secondary education;

     3) ensures the quality of secondary education, including evening (shift) education, and secondary education provided through residential education organizations (with the exception of educational organizations in correctional institutions of the penal (penitentiary) system);

     4) organizes and ensures the quality of the provision of technical and vocational, post-secondary education;

     5) creates, reorganizes and liquidates, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, state educational organizations implementing general educational programs for preschool education and training, primary, basic secondary and general secondary, technical and vocational, post-secondary education, additional education for children, as well as state educational organizations implementing specialized general education and special educational programs;

     6) - 6-2) are excluded by the Law of the Republic of Kazakhstan dated 24.10.2011 No. 487-IV (effective six months after its first official publication);

     7) approves the state educational order for the training of personnel with higher and postgraduate education;

     7-1) approves the state educational order for preschool education and training, the amount of parental fees;

     7-2) approves the state educational order for secondary education in state educational organizations;

     7-3) approves the state educational order for the training of personnel with technical and vocational, post-secondary education;

     7-4) Approves the state educational order for additional education of children within the limits of the budget funds approved in local budgets for the relevant financial year.;

     7-5) approves and places a state educational order for special psychological and pedagogical support for children with disabilities within the limits of budget funds approved in local budgets for the relevant fiscal year;

     8) organizes the participation of students in the unified national testing;

     9) annually, until August 1, organizes the purchase and delivery of textbooks and teaching materials for state organizations of secondary education, as well as educational organizations implementing educational programs of technical and vocational education, specialized general education and special educational programs;

     10) ensures the quality of the provision of additional education for children;

     11) allocates funds for the provision of financial and material assistance to students and pupils of state educational organizations from families eligible for state targeted social assistance, as well as from families not receiving state targeted social assistance, in which the average per capita income is below the subsistence level, and orphans, children left without parental care, living in families, children from families requiring emergency assistance as a result of emergency situations, and other categories of students and pupils, determined by the collegial management body of the state educational organization, in the amount of at least two percent of the total budget allocated for the current maintenance of secondary schools and for the placement of a state educational order for secondary education in state-owned enterprises on the right of economic management;

     12) provides logistical support to state educational organizations (with the exception of educational organizations in correctional institutions of the penal system) and pre-school education and training organizations;

     17) provides rehabilitation and social adaptation of children and adolescents with developmental problems;

18) ensures the quality of staff retraining and advanced training of employees of state educational organizations funded by budgetary funds;

     19) provides state support for orphaned children and children left without parental care in accordance with the established procedure;

     20) organizes, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, medical care for students and pupils of educational organizations, with the exception of preschool organizations and secondary education organizations that do not belong to boarding schools;

     21) organizes, in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan, free and reduced-price meals for certain categories of students and pupils;

     22) promotes the employment of persons who have graduated from educational organizations implementing educational programs of technical and vocational, post-secondary, higher and postgraduate education on the basis of a state educational order;

     24-1) Is excluded by the Law of the Republic of Kazakhstan dated 05/03/2022 No. 118-VII (effective ten calendar days after the date of its first official publication).      

24-2) Excluded by the Law of the Republic of Kazakhstan dated 02/23/2024 No. 64-VIII (effective sixty calendar days after the date of its first official publication).

     25) appoints and dismisses the first head of the educational management body.;

     25-8) provides the material and technical base of teaching classrooms;

     25-9) pays the grant "The best organization of technical and vocational, post–secondary education" to the winners of the competition - state organizations of technical and vocational, post-secondary education;

     26) ensures the functioning of juvenile adaptation centers and support centers for children in need of special social services;

     27) provides conditions for persons detained in juvenile adaptation centers and support centers for children in need of special social services;

     27-1) rotates the first heads of state educational organizations in accordance with the rules of rotation of the first heads of state educational organizations;

     28) exercises, in the interests of local government, other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.

     3-1. Local executive bodies of regions, cities of republican significance and the capital carry out the functions assigned to them through the relevant educational management bodies and the offices of district akims in cities of republican significance and the capital.

     Education departments located in districts, cities or districts in cities of regional and republican significance, the capital, are accountable and controlled by the education departments of regions, cities of republican significance, the capital.

The Law of the Republic of Kazakhstan dated July 27, 2007 No. 319-III.

This Law regulates public relations in the field of education, defines the basic principles of state policy in this field and is aimed at ensuring the constitutional right of citizens of the Republic of Kazakhstan, as well as foreigners and stateless persons permanently residing in the Republic of Kazakhstan, to education.
