Article 6. Personnel Management Service (HR Department) The Law on the Civil Service of the Republic of Kazakhstan

Article 6. Personnel Management Service (HR Department) The Law on the Civil Service of the Republic of Kazakhstan

     1. Personnel Management Service (HR Department) within its competence:

     1) coordinates the activities of the structural divisions of the state body for the implementation of the legislation of the Republic of Kazakhstan in the field of public service;

     2) organizes the activities of disciplinary, competitive and other personnel commissions;

     3) ensures compliance with the procedures for evaluating the activities of administrative civil servants, competitive selection, promotion of civil servants, official investigations, bringing civil servants to disciplinary responsibility, and dismissal of civil servants;

     4) organizes the selection of personnel, draws up documents related to the passage of civil servants in the civil service, records the personal data of civil servants, information on the results of evaluating the activities of administrative civil servants and training, including in the unified automated database (information system) for civil service personnel;

     4-1) organizes the selection of contract employees and the process of concluding, amending and terminating the contract with them;

     5) ensures compliance with restrictions related to public service;

     6) organizes internships, mentoring, performance evaluation, training, retraining and advanced training of civil servants in accordance with established deadlines, develops a procedure for the application of incentives for civil servants;

     7) exercise other powers established by the legislation of the Republic of Kazakhstan.

     2. The Personnel Management Service (HR service) is organizationally independent from other structural divisions of a state body, directly subordinated to the head of the staff, and in a state body that manages foreign policy activities or in which the position of head of staff has not been introduced, to the head of the state body.

     3. In regions, cities of republican significance, the capital, districts, cities, it is allowed to create, in accordance with the legislation of the Republic of Kazakhstan in the field of public service, a unified personnel management service (HR service) for executive bodies funded from the budgets of the relevant administrative-territorial units. The Unified Personnel Management Service (HR service) of regional, cities of republican significance, the capital, district, and city executive bodies funded from local budgets is created by decision of an official (body) authorized to appoint the heads of these executive bodies.

     For district and city territorial divisions of the central state body and its departments, it is allowed to create a single personnel management service (HR service) in an interregional or regional territorial division of the central state body and its departments. A unified personnel management service (HR service) of district and city territorial divisions is created by decision of the head of an interregional or regional territorial division of a central government agency and its department or a higher authority.

     By decision of the head of the central government agency, it is allowed to create a unified personnel management service (HR service) for the central government agency, its departments and territorial divisions.

     By the decision of the head of the department of the central state body, it is allowed to create a unified personnel management service (HR service) for the department of the central state body and its territorial divisions.
