1. A digital record, the confirmation of the authenticity, ownership and immutability of which is provided by means of an electronic digital signature, is recognized as an electronic document.

An electronic document must be able to be handled and stored outside the digital system in which it was created, without changing its properties.

2. An electronic document that meets the requirements of this Code and is certified by an electronic digital signature of a person authorized to sign it is equivalent to a signed document on paper.

3. Electronic documents are generated, stored and submitted through state and (or) non-state digital systems, as well as outside them in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

4. The procedure for collecting, processing, storing, transmitting, searching, distributing, using, protecting, registering, confirming and destroying electronic documents and other data containing information constituting state secrets using secure digital systems classified as state secrets, as well as the procedure for creating, accrediting and terminating the activities of a special The certification center is determined by the National Security Committee of the Republic of Kazakhstan.

5. Electronic documents of state bodies are transferred for state storage to digital archives in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

6. The head of a legal entity or a person replacing him/her has the right to authorize an employee of this legal entity or a person appointed by him/her to sign electronic documents. At the same time, each employee uses an electronic digital signature public key certificate received in his name and the corresponding electronic digital signature private key.
