1. The State shall ensure the allocation of budgetary funds for education, taking into account its priority.

2. Financing of state educational organizations is carried out at the expense of budgetary funds on the basis of the requirements established by the state mandatory standards of education for levels of education and norms determined by the legislation of the Republic of Kazakhstan.

3. Financing of state educational institutions from budgetary funds ensures the maintenance and performance of the functions of institutions in accordance with state mandatory education standards.

Financing of state educational institutions in which per capita regulatory financing is implemented is carried out in the amount determined by the per capita regulatory financing methodology and other expenses provided for by the legislation of the Republic of Kazakhstan.

4. Financing of state-owned educational enterprises and educational organizations of other organizational and legal forms is carried out on the basis of a state educational order.

The volume of the state educational order for state-owned educational enterprises is determined in accordance with the per capita regulatory financing methodology and other expenses provided for by the legislation of the Republic of Kazakhstan, with the exception of the Academy of Justice, medical, military, special educational institutions, cultural education organizations, as well as republican secondary education organizations, the amount of funding for which is determined by the authorized body of the relevant industry independently.

The list of services related to the state educational order is approved by the authorized body in the field of education.

The proceeds from the sale of services provided under the state educational order, remaining as a result of the financial and economic activities of educational organizations for the current financial year, are used by them in the next financial year.

4-1. Excluded by the Law of the Republic of Kazakhstan dated 07/04/2018 No. 171-VI (effective ten calendar days after the date of its first official publication).

4-2. Local executive bodies place a state educational order for secondary education in state educational organizations.

4-3. The placement of a state educational order for secondary education in private educational institutions is entrusted to the operator of the authorized body in the field of education.

4-4. Local executive bodies of oblasts, cities of republican significance, and the capital city place a state educational order for additional education for children within the limits of budget funds approved in local budgets for the relevant fiscal year.

5. The state educational order for personnel training, advanced training and retraining of qualified workers and specialists must contain:

1) areas of personnel training;

2) the volume of the state educational order for the forms of education (number of places, grants);

3) the average cost of tuition per student (specialist).

When placing a state educational order for the training of personnel with technical and professional, post-secondary, higher or postgraduate education in state educational institutions, the administrator of the budget program and the name of the educational organization are indicated.

The state educational order also includes the training of personnel in educational institutions and (or) their branches established in accordance with paragraph 4 of Article 65 of this Law, as well as the training of foreigners and stateless persons in the preparatory departments of organizations of higher and (or) postgraduate education.

5-1. Financing of training of personnel with higher or postgraduate education on the basis of an educational grant or a state educational order is carried out in educational organizations that have been accredited by accreditation bodies included in the register of recognized accreditation bodies, and taking into account the results of ranking organizations of higher and (or) postgraduate education, and taking into account the results of ranking organizations of higher and (or) postgraduate education. education, with the exception of the Justice Academy, military, and special education institutions.

The state educational order for the training of personnel with technical and vocational, post-secondary education is placed in educational organizations in accordance with the procedure determined by the authorized body in the field of education, with the exception of military and special educational institutions.

6. The state educational order in educational organizations implementing general educational programs of preschool education and training, with the exception of secondary education organizations implementing general educational programs of preschool education and pre-school classes, is placed in accordance with the procedure determined by the authorized body in the field of education.

6-1. The state educational order placed in secondary education organizations must contain the number of students and the average cost of expenses per student.

6-2. The state educational order for additional education of children must contain the number of students and/or pupils and the average cost of expenses per student and/or pupil.

6-3. A state educational order for special psychological and pedagogical support for children with disabilities must contain the number of students and/or pupils and the average cost of expenses per student and/or pupil.

7. The requirements for the content of the state educational order for the educational and methodological support of the education system are determined by the authorized body in the field of education and (or) the authorized body in the field of science and higher education.

8. The state educational order for financing higher or postgraduate education with the award of a bachelor's or master's degree is placed in the form of educational grants differentially depending on the educational programs, type, status and ranking results of the organization of higher and (or) postgraduate education, with the exception of the Academy of Justice, military, special educational institutions.

9. The financing of the education of foreigners, including persons of Kazakh nationality who are not citizens of the Republic of Kazakhstan, under scholarship programs in Kazakhstani organizations of higher and (or) postgraduate education is carried out by allocating budgetary funds for the appropriate period of study.

This Law regulates public relations in the field of education, defines the basic principles of state policy in this field and is aimed at ensuring the constitutional right of citizens of the Republic of Kazakhstan, as well as foreigners and stateless persons permanently residing in the Republic of Kazakhstan, to education.
