Article 67. Smart contracts of the Digital Code of the Republic of Kazakhstan
1. A smart contract is a contract that provides for the automatic fulfillment of conditions agreed upon in advance by the parties upon the occurrence of certain circumstances through the use of digital technologies.
2. By agreement of the parties, all or part of the terms of a smart contract can be expressed in the form of a program code, if such a code makes it possible to unambiguously determine the content of the rights and obligations of the parties and provides the ability to reproduce the terms in a form accessible to human perception.
3. A smart contract should provide for the procedure for resolving disputes between the parties, in which the final decision on the dispute is made by a person in accordance with the procedure established by the legislation of the Republic of Kazakhstan or the agreement of the parties.
4. Subjects of legal relations have the right to use insurance and other mechanisms of protection against risks associated with technical errors, software malfunction or failure of the digital platform to function, resulting in non-fulfillment or improper fulfillment of obligations under the smart contract.
5. The requirements regarding the use of smart contracts in certain fields of activity are established by this Code and (or) the laws of the Republic of Kazakhstan.

This Code regulates public relations related to the implementation of architectural, urban planning and construction activities in the Republic of Kazakhstan, the formation of a full-fledged habitat and human activity, planning and development of settlements, interuniverse territories, ensuring the safety of construction sites at all stages of their life cycle.
