Article 68. Urban planning regulations of the Building Code of the Republic of Kazakhstan

Article 68. Urban planning regulations of the Building Code of the Republic of Kazakhstan

     1. Urban planning regulations for the use of construction sites, as well as any changes in their condition during the management of the state urban planning cadastre, are characterized by the types, types and parameters of preferences, prohibitions, restrictions and other regimes in force within the prescribed period.

     The source of urban planning regulations is the urban planning and architectural and construction documentation approved in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     2. The classifier of urban planning regulations and their indicators are established at the national and local levels in accordance with the legislation of the Republic of Kazakhstan.

     3. The system of urban planning regulations for maintaining the state urban planning cadastre should cover the following types::

     1) assignment and (or) modification of the functional use of the territory (land plot) and related real estate in the implementation of architectural, urban planning and construction activities;

     2) the intensity of development and development of the territory (land) and settlements;

     3) ensuring the balance of development and development (building) of the territory (land) and settlements;

     4) the impact of the development of the territory (land) and settlements on the environment.

     4. The purpose and (or) modification of the functional use of the territory (land plot) and related real estate in the implementation of architectural, urban planning and construction activities are implemented in urban planning regulations of the following types:

     1) functional purpose and (or) modification of the territory (land plot);

     2) the functional purpose of the construction and reconstructed facilities;

     3) changing the functional use of existing construction facilities.

     5. The development and arrangement (building) of territories (land) and settlements should be reflected in the urban planning regulations of the following types::

     1) the scale of the developed territories (land plot);

     2) prohibitions, permits and restrictions on certain types of architectural, urban planning and construction activities for a given territory (land plot);

     3) loads on the territory (land plot) as a result of ongoing architectural, urban planning and construction activities;

     4) modes of development and changes in objects of architectural, urban planning and construction activities as a result of ongoing architectural, urban planning and construction activities;

     5) formation of the planning structure and architectural appearance of the settlement (component parts of the settlement);

     6) the formation (improvement) of the social, recreational, transport and engineering infrastructure of the settlement or its part.

     6. The balance of development and arrangement (building) of the territory (land plot) and the settlement should be provided by urban planning regulations of the following types::

     1) resource conditions for the development of architectural, urban planning and construction activities;

     2) environmental conditions of territories (land plots) and settlements;

     3) engineering living conditions of the population.

     7. The impact of the development of territories (land plots) and settlements on the environment is regulated by urban planning regulations of the following types:

     1) placement of ecologically and epidemiologically significant facilities;

     2) the placement of construction sites that pose a man-made hazard;

     3) the location of the human habitat relative to the sources of natural hazards;

     4) sanitary, fire-fighting and other mandatory requirements;

     5) engineering and transportation conditions.

     8. Information on urban planning regulations must be entered into the state urban planning cadastre.

This Code regulates public relations related to the implementation of architectural, urban planning and construction activities in the Republic of Kazakhstan, the formation of a full-fledged habitat and human activity, planning and development of settlements, interuniverse territories, ensuring the safety of construction sites at all stages of their life cycle.
