Article 7. Competence of the authorized body code of the Republic of Kazakhstan on Public Health and the healthcare system
Authorized body:
1) performs strategic, regulatory, implementation, and supervisory functions within its competence;
1-1) on the basis of and in pursuance of the main directions of the internal and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, forms the state policy in the field of healthcare in accordance with the legislation of the Republic of Kazakhstan;
2) organizes the formation of a healthy lifestyle and healthy diet;
3) excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication).
4) introduces new methods of prevention, diagnosis, treatment of diseases and conditions of medical rehabilitation, as well as control over them;
5) excluded by the Law of the Republic of Kazakhstan dated 04/25/2025 No. 185-VIII (effective ten calendar days after the date of its first official publication).
6) forms a list of the guaranteed amount of free medical care;
7) formulates a list of medical care in the compulsory social health insurance system;
7-1) determines the procedure, types and volume of medical care to the population in emergency situations, the introduction of a state of emergency;
8) carries out international cooperation in the field of healthcare, including on educational and scientific activities in the field of healthcare;
9) implements international projects in the field of healthcare;
9-1) defines the national operator in the field of healthcare, its functions and powers;
9-2) defines a single distributor;
10) carries out intersectoral coordination of activities on the introduction and implementation of international health regulations;
10-1) approves the list of diseases that are grounds for exemption from fingerprint registration, in coordination with the Ministry of Internal Affairs of the Republic of Kazakhstan;
11) approves the rules for determining the cases (events) of a medical incident, their accounting and analysis;
12) recognizes the requirements of the world's leading pharmacopoeias in force in the territory of the Republic of Kazakhstan;
13) carries out state regulation of prices for medicines;
14) carries out state regulation of prices for medical devices, medical devices for diagnostics outside a living organism (in vitro), manufactured in the territory of the Republic of Kazakhstan under long-term supply contracts concluded with a Single distributor, within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
15) approves the list of medicines and medical products for free and (or) preferential outpatient care for certain categories of citizens of the Republic of Kazakhstan with certain diseases (conditions), as well as the list of medicines and medical products purchased from a single distributor;
15-1) determines the procedure for organizing and conducting the purchase of medicines, medical devices and specialized medical products within the guaranteed volume of free medical care, additional medical care for persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system, at the expense of budgetary funds and (or) in the system of compulsory social health insurance, pharmaceutical services;
15-2) determines the procedure for the purchase of services for the storage and transportation of medicines and medical products, services for the accounting and sale of medicines and medical products by a single distributor within the guaranteed volume of free medical care, additional medical care for persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system, at the expense of budgetary funds funds and (or) in the compulsory social health insurance system;
16) excluded by the Law of the Republic of Kazakhstan dated 04/25/2025 No. 185-VIII (effective ten calendar days after the date of its first official publication).
17) ensures the development of medical and pharmaceutical science, medical and pharmaceutical education, and coordinates scientific and educational activities in the field of healthcare;
17-1) approves the minimum standards for equipping simulation rooms (centers) of healthcare education organizations and simulation rooms (centers) of healthcare organizations;
17-2) approves the rules of admission to study in the organization of education in the field of healthcare in coordination with the authorized body in the field of science and higher education.;
17-3) approves the rules for determining the need for personnel in the field of healthcare and the volume of admission to training in medical specialties;
17-4) approves the need for personnel in the field of healthcare and the volume of admission for training in medical specialties;
17-5) approves the rules for organizing and financing the training of medical and pharmaceutical personnel;
17-6) determines the procedure for hiring a specialist who has studied on the basis of a state educational order.;
18) places a state educational order for the training and advanced training of personnel in the field of healthcare;
19) carries out certification of professional competence of the persons specified in paragraph 3 of Article 26 of this Code;- Excluded by the Law of the Republic of Kazakhstan dated July 17, 2025 No. 213-VIII SAM
20) participates in the development of a list of professions, jobs and specialties engaged in work with harmful working conditions, for the benefit of which agents for the payment of mandatory occupational pension contributions at their own expense carry out mandatory occupational pension contributions;
21) formulates a unified long-term plan for the development of healthcare infrastructure;
22) coordinates regional long-term plans for the development of healthcare infrastructure;
23) carries out coordination and methodological guidance of local executive bodies in the field of healthcare;

25) coordinates the activities of healthcare entities;
26) implements measures to equip public health organizations;
27) excluded by the Law of the Republic of Kazakhstan dated 04/25/2025 No. 185-VIII (effective ten calendar days after the date of its first official publication).
28) defines a unified methodology for organizations that have the right to conduct a risk assessment and establish the procedure for conducting a risk assessment;
29) approves the healthcare digitalization strategy;
30) creates and ensures the functioning of digital resources and digital systems, information and communication networks in the field of healthcare, organization of access to them for individuals and legal entities in accordance with the digital legislation of the Republic of Kazakhstan;
30-1) provides the society and the state with objective information about the state of the healthcare system by placing official statistical and other information in the public domain, determined according to the unified list of open data of government agencies posted on the Internet portal of open data;
31) approves, within its competence, regulatory legal acts and forms of accounting and reporting documentation in the field of healthcare;
31-1) approves the list of documentation required to be completed by medical professionals;
32) approves standards in the field of healthcare;
33) excluded by the Law of the Republic of Kazakhstan dated 04/25/2025 No. 185-VIII (effective ten calendar days after the date of its first official publication).
34) approves the rules for the use of technical controls, monitoring and recording devices, photographic and video equipment used in medical organizations in order to ensure the protection of the rights of patients and medical workers;
35) approves the rules for awarding honorary titles in the field of healthcare;
36) approves the rules of the sectoral incentive system;
37) approves the standard remuneration system for employees of state-owned enterprises on the right of economic management in the field of healthcare;
38) determines the procedure for certification of professional competence of specialists in the field of healthcare;
39) approves standard staffing and staffing standards for healthcare organizations and (or) their structural divisions;
40) approves the regulations on the national Coordinator for Human Resources of Healthcare;
41) approves the rules for confirming the results of continuous professional development, assignment and confirmation of the qualification level of healthcare system employees;
42) approves the nomenclature of specialties and specializations in the field of healthcare, the nomenclature and qualification characteristics of positions of employees of the healthcare system;
43) approves the list of medicines and medical devices purchased by a single distributor under long-term contracts for the supply of medicines and medical devices;
44) approves the rules for assessing the quality of medicines and medical devices registered in the Republic of Kazakhstan;
45) approves the rules for the formation of the register of healthcare entities engaged in the wholesale and retail sale of medical products, in a notification manner;
46) approves the Kazakhstan National Medicinal Formulary;
47) approves the rules for the formation of pharmaceutical formulas of healthcare organizations;
48) approves the rules for evaluating the rational use of medicines;
49) approves the rules for the provision of medicines and medical products within the framework of the guaranteed volume of free medical care, additional medical care for persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system, at the expense of budgetary funds and (or) in the system of compulsory social health insurance;
50) approves the rules for the formation of a list of medicines and medical devices for free and (or) preferential outpatient care for certain categories of citizens of the Republic of Kazakhstan with certain diseases (conditions) and a list of medicines and medical devices purchased from a single distributor;
51) approves the rules for regulating prices for medicines, as well as for medical devices within the framework of the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
52) approves the rules for the maintenance of medical devices in the Republic of Kazakhstan;
53) approves the methodology for the expert assessment of optimal technical characteristics and clinical and technical justification of medical devices;
54) approves the rules of cooperation on contractual fractionation;
55) approves the composition of the first aid kit;
56) approves the rules for the purchase of goods and services for the examination of state registration of medicines and medical devices and assessment of their safety and quality;
57) approves the list of medicines and medical devices necessary for the provision of emergency and emergency medical care in healthcare organizations;
58) approves the regulations on the national coordinator for international health regulations;
59) approves the standard form of the contract for the provision of paid medical services (assistance);
59-1) approves the rules for the organization of medical care for persons with tuberculosis held in institutions of the penal (penitentiary) system, in coordination with the Ministry of Internal Affairs of the Republic of Kazakhstan;
59-2) approves the rules for conducting a medical examination of convicts who are being presented for release from serving their sentences due to illness, and determines the list of diseases that are the basis for release from serving their sentences, in coordination with the Ministry of Internal Affairs of the Republic of Kazakhstan.;
59-3) determines the procedure for purchasing and paying for the services of healthcare entities for providing medical care to persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system at the expense of budgetary funds;
59-4) approves the standard staff and staffing standards of medical organizations providing medical care to persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system;
59-5) approves the rules and methodology for the formation of tariffs for medical services provided as part of the additional volume of medical care to persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system, at the expense of budgetary funds;
59-6) approves the minimum standards for equipping medical equipment and medical devices of medical organizations providing medical care to persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system;
59-7) approves the procedure and conditions for providing psychological assistance to persons who have committed an administrative or criminal offense involving violence in healthcare organizations;
60) approves the rules for sending citizens of the Republic of Kazakhstan for treatment abroad and (or) attracting foreign specialists for treatment in domestic medical organizations within the guaranteed volume of free medical care;
60-1) approves the rules for the use of lump-sum pension payments for medical treatment;
61) excluded by the Law of the Republic of Kazakhstan dated 04/25/2025 No. 185-VIII (effective ten calendar days after the date of its first official publication).
62) approves the rules for the purchase of services from healthcare entities for the provision of medical care within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
63) approves the rules for planning the volume of medical services within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
63-1) develops and approves, in coordination with the authorized bodies for budget planning and budget execution, rules for planning and allocating budget funds to the social health insurance fund, forms and deadlines for reporting on funds for medical care;
63-2) approves the methodology for planning the volume of medical care within the framework of the guaranteed volume of free medical care and medical care in the system of compulsory social health insurance based on the needs of the population;
64) approves the rules and methodology for the formation of tariffs for medical services provided within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
65) approves tariffs for medical services provided within the guaranteed scope of free medical care and (or) in the system of compulsory social health insurance;
66) approves the rules for keeping records of consumers of medical services and granting the right to receive medical care in the compulsory social health insurance system;
67) approves the rules for keeping records of healthcare entities providing medical care within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
68) approves the state standard of the network of healthcare organizations;
69) approves the rules for the formation, coordination and approval of a unified long-term plan for the development of healthcare infrastructure;
70) approves the nomenclature of healthcare organizations and regulations on their activities;
71) Approves minimum standards for equipping healthcare organizations with medical products;
72) approves professional standards in the field of healthcare;
73) Approves the rules for conducting medical examinations of persons applying for the right to drive vehicles;
74) Approves the rules for conducting a medical examination to establish the fact of using a psychoactive substance and intoxication;
74-1) approves the rules for conducting procedures to identify signs of the use of narcotic drugs, psychotropic substances and their analogues in civil servants and formalize their results jointly with the authorized body for civil service affairs;
75) approves the rules for the collection, storage and use of blood and tissues of persons exposed to ionizing radiation;
76) Approves the list of diseases associated with exposure to ionizing radiation and the rules for establishing a causal relationship.;
77) approves the list of medical contraindications available to persons with mental and behavioral disorders (diseases) related to the use of psychoactive substances, for which referral to an organization providing medical care in the field of mental health is not applied.;
78) approves the rules for the development and revision of clinical protocols;
79) Approves the methodology for the implementation and evaluation of the effectiveness of the implementation of clinical protocols in practical healthcare;
80) approves the qualification requirements for medical and pharmaceutical activities;
81) Approves the rules for the provision of medical care through mobile medical complexes and medical trains;
82) Approves the rules for the provision of medical care in accordance with the types established by Article 120 of this Code;
83) approves the rules for providing sign language assistance to the population of the Republic of Kazakhstan;
84) Approves the nomenclature, rules for procurement, processing, quality control, storage, sale of blood and its components, as well as rules for blood transfusion and its components;
85) approves the rules and conditions for the removal, procurement, storage, conservation, transportation, and transplantation of organs (parts of an organ) and (or) tissues (parts of tissue) from a donor to a recipient;
86) Approves the rules for connecting electronic digital resources containing personal medical data to telecommunications networks linking them to other databases in the field of healthcare, in coordination with the authorized body in the field of digital security;
87) approves standards, classification systems, reference books and nomenclatures in the field of digital healthcare;
88) approves the minimum requirements for medical digital systems in the field of healthcare;
89) Approves requirements for electronic digital resources for remote medical services;
90) approves instructions on coding morbidity and mortality, instructions on the use of international classifiers;
91) approves the methodology for the formation of tuition fees for health education programs in coordination with the authorized body in the field of education.;
92) determines the procedure and methodology for the formation of the need for medicines and medical devices within the framework of the guaranteed volume of free medical care, additional medical care for persons held in pre-trial detention facilities and institutions of the penal (penitentiary) system, at the expense of budgetary funds and (or) in the system of compulsory social health insurance;
93) approves the rules for co-payment;
94) approves the rules for the formation of marginal prices and margins for medicines and (or) medical devices within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
95) formulates and approves marginal prices and margins for medicines and (or) medical devices within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
96) approves the marginal prices for the trade name of a medicinal product for retail and wholesale sale;
97) carries out activities on the formation, monitoring of the implementation and evaluation of the results of the state social order in the field of public health protection for non-governmental organizations, including for key population groups;- Excluded by the Law of the Republic of Kazakhstan dated July 17, 2025 No. 213-VIII SAM
98) defines the list of occupational diseases;
98-1) approves the rules for determining the severity of an occupational injury;
99) approves the rules for monitoring the fulfillment of the terms of the contract for the purchase of medical services from healthcare entities within the guaranteed volume of free medical care and (or) in the system of compulsory social health insurance;
100) approves the rules for encouraging employees of healthcare entities who provide medical services within the guaranteed scope of free medical care and (or) in the system of compulsory social health insurance;
101) participates in the formation and implementation of state policy in the medical and pharmaceutical industries;
101-1) defines cases of importation into the territory of the Republic of Kazakhstan as humanitarian aid of medicines and medical devices that have not passed state registration in the Republic of Kazakhstan;
101-2) Approves the list of potent substances, as well as medical gases that have harmful effects on human life and health;
102) Approves the rules for the organization of medical care for the period of the state of emergency in accordance with the Law of the Republic of Kazakhstan "On the State of Emergency";
103) Approves nutrition standards in healthcare and educational organizations;
104) Approves the rules for conducting confidential audits in medical organizations;
104-1) approves the regulations on the activities of the medical advisory Commission;
104-2) defines the list of strategically important medicines and medical devices;
104-3) Approves the standard contract for co-insurance of professional liability of medical workers and the standard contract for co-insurance of life and health of medical workers in the exercise of their professional duties in coordination with the authorized body for regulation, control and supervision of the financial market and financial organizations.;
104-4) approves the rules of professional liability insurance for medical workers, life and health of medical workers in the exercise of their professional duties in coordination with the authorized body for regulation, control and supervision of the financial market and financial organizations.;
104-5) approves the list of technical auxiliary (compensatory) means and (or) special means of transportation for children with disabilities after illnesses accompanied by temporary restriction of motor functions, with the exception of children with disabilities;
104-6) Approves the rules for the provision of technical auxiliary (compensatory) means and (or) special means of transportation for children with disabilities after illnesses accompanied by temporary restriction of motor functions, with the exception of children with disabilities;
105) performs other functions stipulated by this Code, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
