Article 7. Film rental and screening of the Law on Cinematography
1. The rental and screening of a film in the territory of the Republic of Kazakhstan, except for the cases of showing the film at festivals, seminars, and retrospectives, is carried out only upon its registration in the State Film Registry and in accordance with the issued rental certificate.
This requirement does not apply to films produced by cinematographic organizations of the former USSR.
2. A rental certificate is issued for a film registered in the State Register of Films.
3. The rental certificate is issued in accordance with the form approved by the authorized body.
4. To obtain a rental certificate, an individual or a legal entity must submit:
1) an application addressed to the head of the authorized body;
2) documents confirming the right of an individual or legal entity to the film or its use (notarized copies in Kazakh and/or Russian are attached to documents in a foreign language);
3) Movie annotation;
4) information about the works used in films produced in the Republic of Kazakhstan. -Excluded by the Law of the Republic of Kazakhstan dated February 18, 2026 No. 266-VIII SAM
5. The application for a rental certificate is subject to review within thirty working days from the date of receipt. Based on the results of consideration of the application, the authorized body issues a rental certificate to an individual or legal entity.
5-1. The authorized body requests a version of the film intended for film distribution in order to conduct a pre-distribution examination if it is impossible to identify the features provided for in subparagraph 4) from the submitted annotation of the film. paragraph 6 of this article, as well as determine the age category of the film.
A pre-screening examination is an examination conducted by an expert commission to identify the presence in a film of the features listed in subparagraph 4) of paragraph 6 of this article, as well as to determine the age category of the film.
The pre-distribution examination of the film version intended for film distribution in order to obtain a rental certificate is carried out by an expert commission consisting of representatives of government agencies, experts and specialists established under an organization determined by the authorized body.
The expert commission reviews the version of the film intended for distribution and sends recommendations to the authorized body within no more than ten working days from the date of the film's submission.
The decision of the expert commission is drawn up in a protocol and is advisory in nature.
The procedure for conducting a pre-distribution examination of films, as well as the organization of the work of the expert commission and its composition are determined by the authorized body.
6. The authorized body refuses to issue a rental certificate to an individual or legal entity on the following grounds:
1) provision by an individual or legal entity of false and (or) distorted information;
2) failure by an individual or legal entity to submit the documents and materials specified in paragraph 4 of this article;
3) in case of non-compliance with the requirements provided for in paragraphs 3 and 5 of Article 9 of this Law;
4) if the content of the film is aimed at propaganda or agitation of a violent change in the constitutional order, violation of the integrity of the Republic, undermining the security of the state, inciting social, racial, national, religious, class and clan discord, the cult of cruelty and violence, non-traditional sexual orientation, pedophilia, as well as pornography.
7. In case of establishing the facts of unreliability and (or) distortion of information about the film revealed during monitoring, which previously served as the basis for issuing a rental certificate, including on the basis of the annotation of the film, the authorized body suspends the validity of the rental certificate.
The validity of the rental certificate is suspended for the period necessary to eliminate the reasons that led to the suspension of the rental certificate, but not more than sixty calendar days.
A decision to suspend the validity of a rental certificate is issued by order of the person who issued it or the person replacing it, within three working days from the date the circumstances were revealed by the authorized body and comes into force from the date the individual or legal entity who received the rental certificate is notified of the decision.
The validity of the rental certificate is renewed by an order of the person who suspended the validity of the rental certificate, or the person replacing it, within three working days from the date of registration of a written application from the individual or legal entity who received the rental certificate, to eliminate the circumstances that previously led to the suspension of the rental certificate.
If the circumstances that previously served as the basis for suspending the validity of the rental certificate are not eliminated, the authorized body shall revoke the rental certificate in court.
This Law regulates public relations and defines the legal, economic and organizational foundations of the field of cinematography.
