Article 73. Civil plaintiff of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. A natural or legal person who has filed a civil claim for compensation for property or moral damage caused by a criminal offense or an act of an insane person is recognized as a civil plaintiff.
2. In order to maintain the claim brought by him, the civil plaintiff has the right:
1) to know the essence of suspicion, accusation;
2) to present evidence;
3) to give explanations on the brought claim;
4) submit materials for inclusion in the criminal case;
5) file petitions and challenges, give evidence and explanations in their native language or a language they speak;
6) use the free help of an interpreter, have a representative;
7) get acquainted with the protocols of investigative actions carried out with his participation;
8) participate, with the permission of the prosecutor, investigator or inquirer, in investigative actions carried out at his request or at the request of his representative;
8-1) express consent to the application of writ proceedings in the case of a criminal offense or a minor offense;
9) upon completion of the investigation, get acquainted with the case materials related to the civil claim and extract any information from it in any volume, with the exception of information constituting state secrets.;
10) to know about the decisions taken affecting his interests and to receive copies of the procedural decisions related to the filed civil claim;
11) participate in the consideration of a civil claim by any court;
12) to speak in court debates;
13) to get acquainted with the minutes of the court session and submit comments on it;
14) bring complaints about the actions (inaction) and decisions of the body conducting the criminal process;
15) appeal the verdict and court decisions regarding the civil claim;
16) to know about the complaints brought in the case, the prosecutor's petitions and protests regarding the civil claim and to file objections to them;
17) participate in the judicial review of the filed complaints, prosecutor's petitions and protests;
18) excluded by the Law of the Republic of Kazakhstan dated 10.01.2018 No. 132-VI (effective from 01.07.2018);
19) declare the adoption of security measures.
3. The civil plaintiff shall bear the obligations stipulated in the eighth part of Article 71 of this Code.
4. The civil plaintiff also has other rights and other duties provided for by law.
