Article 77. Features of social protection of cadets and trainees The Law on Special State Bodies of the Republic of Kazakhstan

     1. Cadets and trainees are provided at the expense of the state with special uniforms and other personal belongings according to the standards approved by the first heads of special state bodies in coordination with the central authorized body for budget planning, taking into account the specifics of their service.

     2. Cadets and trainees who are in a barrack position are provided with food according to the food ration standards approved by the first heads of special state bodies in coordination with the central authorized body for budget planning, taking into account the specifics of their service.

     3. Cadets, first- and second-year students are paid monetary compensation for postal items in the amount determined by the first heads of special state bodies in coordination with the central authorized body for budget planning.

     3-1. Family members of cadets who are citizens of the Republic of Kazakhstan have the right to visit their close relatives from among the cadets to get acquainted with their lives and everyday life in accordance with the procedure determined by the Chairman of the National Security Committee of the Republic of Kazakhstan.

     4. Cadets and trainees have the right to reimbursement of expenses according to the standards approved by the first heads of special state bodies in coordination with the central authorized body for budget planning for travel (from the point of departure to the destination and back):

     1) by rail, air, water and road transport on the territory of the Republic of Kazakhstan when traveling for inpatient treatment;

     2) on railway, water and road transport across the territory of the Republic of Kazakhstan upon dismissal from service in special state bodies, except for the cases provided for in 6), 12-1) and 13) of paragraph 1 of Article 49 of this Law, as well as when going on vacation and internship.

     Cadets and trainees studying in educational institutions of a foreign country are also given the right to travel at the expense of the state (from the point of departure to the destination and back) by air, rail, water and road transport when they are sent for training, internships, and vacations.

     The procedure for reimbursement of costs of cadets, students of military and special educational institutions is determined by the Government of the Republic of Kazakhstan.

     5. Upon departure on leave, cadets and trainees are paid monetary compensation in return for food rations according to the standards approved by the first heads of special state bodies in coordination with the central authorized body for budget planning.

     6. In the event of death (death) of a cadet, student, or after his dismissal from service due to injury (concussion), illness sustained during service, his heirs are paid a one-time compensation in the amount of 500 monthly calculation indices.

     7. A one-time compensation for the establishment of a disability to a cadet or student, received during his service in special state bodies or as a result of contusion, injury, or illness related to service in special state bodies, before the expiration of one year from the date of dismissal from service, is paid in the amount of:

     a person with a disability of the first group – 250 monthly calculation indices;

     for a person with a disability of the second group – 150 monthly calculation indices;

     for a person with a disability of the third group – 50 monthly calculation indices.

     8. If a cadet or student receives a serious injury (injury, injury, contusion) during the performance of duties in special state bodies that did not result in disability, he is paid a one-time compensation in the amount of:

     for severe injury – 12 monthly calculation indices;

     for a minor injury – 4 monthly calculation indices.

     9. One-time compensation is paid in accordance with the procedure established by the Government of the Republic of Kazakhstan.

     10. A one-time compensation is not paid if, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, it is proved that the death (death) of a cadet, student or injury has occurred.:

     1) as a result of suicide, except in cases of driving to suicide;

     2) when he commits criminal or administrative offenses;

     3) as a result of the use or application of substances that cause a state of alcoholic, narcotic, psychotropic, substance abuse intoxication (their analogues);

     4) as a result of intentionally inflicting any bodily injury (self-mutilation) or other harm to one's health in order to receive one-time compensation or evade service;

     5) as a result of the actions of a cadet or student who violated the terms of the contract.

     11. Cadets and trainees who have been dismissed for health reasons as a result of injury (injury, injury, contusion) sustained in the performance of their duties are paid monthly in the amount and in the manner determined by the Government of the Republic of Kazakhstan.

     12. In the event of death (death) of a cadet or student as a result of injury (injury, injury, contusion) sustained in the performance of service duties, family members of the deceased (deceased) A monthly payment is made to the cadet and the student in the amount and in the manner determined by the Government of the Republic of Kazakhstan.

     Monthly cash payments are made to children (including adopted, adopted, cohabiting stepsons and stepdaughters) until they reach the age of majority or until they graduate from a full-time educational institution in the system of general secondary, technical and vocational, post-secondary education, in the system of higher and (or) postgraduate education within the limits not exceeding twenty-three years of age, and also to the spouse for life, regardless of the payment of survivor's benefits provided for by the Social Code of the Republic of Kazakhstan."

     In case of remarriage to the spouse of the deceased as a result of injury (injury, injury, concussion) received in the performance of service duties, the monthly monetary payment is terminated.

     The monthly cash payment is made from the date of submission of the application by the person entitled to receive it.

 

The Law of the Republic of Kazakhstan dated February 13, 2012 No. 552-IV.

This Law defines the status of special state bodies of the Republic of Kazakhstan (hereinafter referred to as special state bodies), regulates public relations related to admission to service in special state bodies, its passage and termination, and also defines the legal status, financial support and social protection of employees of special state bodies.
