Article 8. Unified commercial gas supply system The Law on Gas and Gas Supply

Article 8. Unified commercial gas supply system The Law on Gas and Gas Supply

  1. In order to ensure the uninterrupted supply of commercial gas to meet the domestic needs of the Republic of Kazakhstan, to ensure the safe operation of gas supply system facilities, to organize continuous dispatch control over the transportation and storage of commercial gas, and to create a unified system for its accounting, a unified commercial gas supply system is being formed in the Republic of Kazakhstan.

     2. The unified commercial gas supply system includes connecting and main gas pipelines, commercial gas storage facilities, gas distribution and gas‑consuming systems, mobile gas filling compressor stations, and other technological facilities designed for the production, transportation, storage, sale, and consumption of commercial gas.

The unified commodity gas supply system does not include field gas pipelines, gas‑consuming systems for household and utility consumers, technological facilities designed for the production and regasification of liquefied natural gas, as well as for the transportation, storage, sale, and consumption of liquefied petroleum gas.

     3. The facilities of the unified commodity gas supply system may be in state or private ownership.

     4. The subjects of the unified commodity gas supply system are:

1) the national operator;2) producers of marketable gas;3) subsoil users who are owners of marketable gas produced during the processing of raw gas extracted by them;4) owners of marketable gas produced outside the territory of the Republic of Kazakhstan and imported for consumption within the territory of the Republic of Kazakhstan.

5) owners of commercial gas produced outside the territory of the Republic of Kazakhstan from raw gas extracted in the Republic of Kazakhstan, on the basis of international treaties of the Republic of Kazakhstan;

     6) gas transportation and gas distribution organizations;

     7) owners of vehicle gas filling compressor stations;

     8) industrial consumers of commercial gas;

     9) industrial consumer‑investors.

10) consumers included in the list of power plants;

11) large commercial consumers;

12) digital miners.

4-1. Large commercial consumers are legal entities, regardless of the amount of gas‑consuming equipment, that purchase commercial gas in a volume of ten million cubic meters or more per year, with the exception of gas transmission and distribution organizations that use commercial gas for their own needs, including standard technical losses, as well as consumers of commercial gas in the volume directly used for the production of:

socially significant food products;

     thermal energy, provided that such consumers are entities of natural monopolies providing regulated services for the production of thermal energy;

     electrical energy sold to a single purchaser of electrical energy in accordance with the legislation of the Republic of Kazakhstan on the power industry;

     electrical energy sold on the balancing market of electrical energy, provided that such consumers are power‑generating organizations that sell electrical energy to a single purchaser of electrical energy in accordance with the legislation of the Republic of Kazakhstan on the power industry.

The provision of paragraph five of part one of this clause does not apply to cases where the electrical energy sold on the balancing market of electrical energy was produced by an energy‑producing organization that is a balance provider or has entered into an agreement to transfer responsibility for imbalances to the balance provider in accordance with the legislation of the Republic of Kazakhstan on the power industry.

     5. The authorized body maintains records and publishes on its website a list of producers of marketable gas, subsoil users who are owners of marketable gas produced during the processing of raw gas extracted by them, owners of marketable gas produced outside the territory of the Republic of Kazakhstan and imported for consumption into the territory of the Republic of Kazakhstan, owners of marketable gas produced outside the territory of the Republic of Kazakhstan from raw gas extracted in the Republic of Kazakhstan, on the basis of international treaties of the Republic of Kazakhstan, and gas transportation and gas distribution organizations.

     6. For the effective operation of the unified commodity gas supply system, producers of commodity gas, gas transmission and gas distribution organizations are required to comply with the established technological operating modes for the facilities of the unified commodity gas supply system.

7. A gas distribution organization must own or have another lawful basis for owning a gas distribution system directly connected to the main gas pipeline.

     8. It is prohibited to transport commodity gas through the gas distribution system simultaneously by two or more gas distribution organizations.

9. Construction of individual gas distribution system facilities

 

The Law of the Republic of Kazakhstan dated January 9, 2012 No. 532-IV.

        This Law defines the legal, economic and organizational bases for regulating public relations in the field of gas and gas supply in the Republic of Kazakhstan and is aimed at creating conditions for meeting the domestic gas needs of the Republic of Kazakhstan, as well as for efficient, reliable and safe operation of gas supply facilities.
