Article 81. Grounds for termination of the right of private ownership of a land plot or the right of land use of the Land Code of the Republic of Kazakhstan

1. The right of private ownership of a land plot or the right of land use is terminated when:

1) alienation of a land plot by the owner or the right of land use by the land user to other persons;

2) the owner's renunciation of the right of ownership or the land user's renunciation of the right of land use;

3) loss of ownership of a land plot or land use rights in other cases provided for by legislative acts of the Republic of Kazakhstan.

2. The seizure of a land plot from the owner and the right of land use from the land user without their consent is not allowed, except in the following cases::

1) foreclosure on a land plot or the right of land use under the obligations of the owner or land user;

2) compulsory alienation of a land plot for state needs;

3) compulsory seizure from the owner or land user of a land plot that is not used for its intended purpose or is used in violation of the legislation of the Republic of Kazakhstan, in the cases provided for in Articles 92 and 93 of this Code.;

4) compulsory alienation from the owner or land user of a land plot that has been exposed to radioactive contamination, with the provision of an equivalent land plot;

5) confiscation.

6) appeals to the state revenue of a land plot in accordance with the legislation of the Republic of Kazakhstan on the return of illegally acquired assets to the state.

3. In addition, the right of land use may be terminated on the following grounds::

1) expiration of the period for which the land was provided;

2) early termination of a lease agreement for a land plot or a temporary gratuitous land use agreement, except in cases where the land plot is pledged;

3) termination of the employment relationship, in connection with which the land user was granted an official land allotment (Article 41 of this Code).

4) change of permanent place of residence from the regions determined by the Government of the Republic of Kazakhstan during the initial five-year period of land use.

5) termination of the right of subsurface use, for the purpose of which the land plot was provided
