1. The authorized agency for entrepreneurship is a government agency responsible for the management and cross-sectoral coordination in the field of development and support of private entrepreneurship.

2. Authorized Body for Entrepreneurship:

1) informs the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan about violations of the legislation of the Republic of Kazakhstan regulating the activities of business entities committed by state bodies and their officials;

1-1) performs strategic, regulatory and implementation functions within its competence;

1-2) on the basis of and in pursuance of the main directions of the internal and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, forms a state policy in the field of state regulation of entrepreneurship in accordance with the legislation of the Republic of Kazakhstan;

2) coordinates the risk assessment system of government agencies by jointly approving risk assessment criteria and checklists developed by authorized government agencies;

3) develops and approves the forms of the test sheets;

3-1) interacts with the authorized body in the field of legal statistics and special accounting on the exchange of information on accounting for inspections and preventive control and supervision of control and supervision bodies;

4) maintains the register of business entities;

4-1) maintains a register of social entrepreneurship entities;

5) develops and approves the rules for maintaining and using the register of business entities;

5-1) approves the rules for maintaining the register of mandatory requirements in the field of entrepreneurship;

5-2) develops and approves rules for the formation of a risk assessment and management system by regulatory state bodies;

6) approves the rules for calculating the average annual number of employees and the average annual income;

7) develops and approves rules for conducting and using regulatory impact analysis of regulatory instruments and (or) requirements;

8) Excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication).

9) provides methodological assistance and coordinates the activities of regulatory government agencies on the implementation of regulatory impact analysis;

10) reviews reports of local executive bodies of the region, the city of republican significance, the capital, which provide leadership in the field of entrepreneurship, on the status of work on the analysis of regulatory impact;

10-1) ensures the activities of the interdepartmental commission on business regulation;

11) organizes training for civil servants and other persons on the implementation and implementation of regulatory impact analysis;

12) conducts an alternative regulatory impact analysis;

13) develops a draft annual report on the state of business regulation in the Republic of Kazakhstan;

13-1) develops and approves a list of information tools;

13-2) excluded by the Law of the Republic of Kazakhstan dated 02.01.2021 No. 399-VI (effective after ten calendar days after the date of its first official publication); 13-3) excluded by the Law of the Republic of Kazakhstan dated 02.01.2021 No. 399-VI (effective after ten calendar days after the date of its first official publication);

13-4) develops a list of informatization facilities of government agencies and organizations to be integrated with the register of business partners in coordination with the National Chamber of Entrepreneurs of the Republic of Kazakhstan;

13-5) develops and approves regulatory legal acts in the field of state regulation of entrepreneurship in accordance with the objectives of this Code and the legislation of the Republic of Kazakhstan;

14) exercises control in the field of support and protection of private business entities.

3. The authorized body for entrepreneurship exercises other powers provided for by this Code, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
