Article 887. Resolution of issues related to the execution of the resolution on the imposition of an administrative penalty, instructions on the need to pay a fine of the Code of the Republic of Kazakhstan on Administrative Offenses
1. The body (official) that issued the resolution on the imposition of an administrative penalty, or the body that issued the eskerta nemesa eskerta nemesa ayyppul toleu kazhettigi turaly, is charged with resolving issues related to the execution of this resolution, instruction, and control over its execution.
2. The issues of postponement, installment, suspension or termination of the execution of the decision on the imposition of an administrative penalty, eskertu nemesa eskertu nemesa ayyppul toleu kazhettigi turaly, as well as the recovery of a fine imposed on a minor from his parents or persons replacing them, are considered by the judge, the body (official) who issued the decision, issued the order, in a three-day period from the date on which the grounds for resolving the relevant issue arise, except in cases of application of the amnesty act.
3. Persons interested in resolving the issues referred to in paragraph two of this Article shall be notified of the place and time of their consideration. At the same time, the non-appearance of interested persons without valid reasons is not an obstacle to resolving relevant issues. When considering the issue of evading administrative arrest, the presence of a person who has been subjected to administrative arrest is mandatory.
4. The decision on the issues specified in the second part of this Article shall be taken in the form of a resolution.
5. A copy of the decision shall be immediately handed over to the individual or representative of the legal entity in respect of whom it was issued, as well as to the victim upon his request against receipt. In the absence of these persons, a copy of the resolution is sent within three days from the date of its issuance, which is recorded in the case file.
