Article 9. Competence of the authorized body, department of the authorized body and its territorial subdivisions in the field of protection, protection, restoration and use of the flora of the Law on Flora

1. Authorized body:

1) implements the state policy in the field of protection, restoration and use of flora;

2) coordinates the activities of central and local executive bodies in the field of protection, restoration, and use of flora;

3) develops and approves the rules for conducting state monitoring and the state cadastre of flora;

4) develops and approves the rules for conducting an inventory of the flora;

5) approves the base rates for calculating the amount of damage caused by violation of the legislation of the Republic of Kazakhstan in the field of protection, restoration and use of flora;

6) develops and approves rules for the formation, storage, accounting and use of botanical collections, collections of plant genetic resources;

7) develops and approves rules for the establishment of restrictions (suspension) of the right to use wild plants;

8) develops and approves rules for handling the gene pool of the plant world;

9) develops and approves the rules for the use of the flora;

10) develops and approves, in coordination with the authorized body in the field of healthcare, a list of medicinal plants.;

11) develops and approves rules for the transfer of naturally growing rare and endangered plant species under protection to land owners, land users and water users;

12) develops and approves a list of endemic and relict plants;

13) develops and approves a methodology for conducting a resource survey of plant resources and determining limits on their use;

14) develops and approves the rules for the accreditation of specialized organizations conducting resource surveys;

15) develops a list of rare and endangered plant species;

16) develops and approves standard rules for the creation, maintenance and protection of green spaces in settlements;

17) provides individuals and legal entities with access to information in the field of protection, conservation, restoration and use of flora;

18) carries out state control in the field of protection, protection, restoration and use of wild plants;

19) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

2. The department of the authorized body and its territorial subdivisions carry out their activities within the competence established by the authorized body and this Law.

This Law regulates public relations and establishes the legal basis of state policy in the field of protection, restoration, and use of flora.
