Article 939. Compensation for damage to the health of a person who has not reached the age of majority of the Civil Code of the Republic of Kazakhstan

     1. In the event of injury or other damage to the health of a minor who has not reached the age of fourteen (minor) and has no income, the persons responsible for the damage are obliged to reimburse the costs associated with the damage to health.

     2. Upon reaching the age of fourteen by the victim, as well as in the case of harm to a minor between the ages of fourteen and eighteen who does not have earnings (income), the persons responsible for the harm are obliged to compensate the victim, in addition to the costs caused by damage to health, also the harm associated with the loss or reduction of his ability to work, based on ten times the established legislative acts of the monthly calculation index.

     If, at the time of the injury to the minor's health, he had earned money, the damage is compensated based on the amount of this earnings, but not less than ten times the monthly calculation index established by legislative acts.

     After starting work, the victim has the right to demand an increase in compensation for damage based on the earnings he receives, but not less than the amount of remuneration established by his position or the earnings of an employee of the same qualification at his place of work.
