Article 95. Repeated voting in the election of deputies of the Mazhilis of the Constitutional Law on Elections in the Republic of Kazakhstan

     1. The Central Election Commission, upon the submission of the relevant territorial or district election commission or appeals from citizens, may invalidate the elections of deputies of the Mazhilis in the relevant administrative-territorial unit or electoral district if violations of this Constitutional Law occurred during the elections or during the counting of votes or when determining the election results, which do not allow to reliably determine the results of the expression of the will of citizens.. In this case, the Central Election Commission appoints a repeat vote in the relevant administrative-territorial unit or electoral district.

     2. Repeated voting is conducted within the time limits set by the Central Election Commission, but not more than one month according to the same party lists and candidates, at the same polling stations and according to the same voter lists that were compiled for the initial elections. The repeated voting is reported in the media.

     3. If more than two candidates for deputies of the Mazhilis of Parliament were included in the ballot and none of them was elected, the district election commission shall schedule a repeat vote on the election of a deputy for the candidates who received the largest equal number of votes. If, as a result of the withdrawal of candidates, one candidate remains, a repeat vote on his candidacy is not held and he is considered elected.
