Article 96. State control in the field of digitalization, as well as in the field of electronic document and electronic digital signature of the Digital Code of the Republic of Kazakhstan

1. State control in the field of digitalization is carried out in the form of inspections, preventive control with a visit to the subject (object) of control and preventive control without a visit to the subject (object) of control, unless otherwise specified in paragraph 4 of this Article.

2. Inspection and preventive control with a visit to the subject (object) of control are carried out in accordance with the Business Code of the Republic of Kazakhstan.

3. Preventive control without visiting the subject (object) of control is carried out in accordance with the Law of the Republic of Kazakhstan "On Cybersecurity" and the Business Code of the Republic of Kazakhstan.

4. State control in the field of electronic document and electronic digital signature is carried out in the form of an unscheduled inspection and preventive control with a visit to the subject (object) of control in accordance with the Business Code of the Republic of Kazakhstan, unless otherwise established by part two of this paragraph.

State bodies are subject to state control in the field of electronic documents and electronic digital signatures in accordance with the Law of the Republic of Kazakhstan "On Cybersecurity".

The requirement of this paragraph does not apply to the National Bank of the Republic of Kazakhstan and organizations included in its structure, and legal entities, fifty or more percent of the voting shares (participation shares in the authorized capital) of which belong to the National Bank of the Republic of Kazakhstan or are in its trust management, as well as special state bodies of the Republic of Kazakhstan.
