Commentary to article 473. Notification of relatives of the convicted person and the civil plaintiff about the appeal of the sentence to execution The Criminal Procedure Code of the Republic of Kazakhstan

After the entry into force of the sentence by which the convicted person in custody is sentenced to detention in the brig or imprisonment, the administration of the place of detention is obliged to inform the family of the convicted person about where he is going to serve his sentence.

The civil plaintiff is notified by the bailiff of the appeal of the sentence to execution in case of satisfaction of the civil claim.

1. The administration of a place of detention is obliged to inform one of the relatives or a legal representative of the convicted person's choice about where he is going to serve his sentence.

2. In case of satisfaction of a civil claim in whole or in part, the civil plaintiff shall be notified by the bailiff. The court establishes and specifies in the verdict the time limit for the voluntary execution of the sentence in respect of the civil claim. Enforcement is carried out in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Enforcement proceedings and the status of Bailiffs". Upon receipt of the enforcement document, the bailiff initiates enforcement proceedings, which he issues a resolution on. The terms of the appeal of the verdict in the part of the civil claim are determined by the legislation on enforcement proceedings.
