Article 9. Fishery reservoirs and (or) sites for the implementation of lake-commercial and (or) cage economic activities of the Law on Aquaculture of the Republic of Kazakhstan

1. Fishery reservoirs and (or) areas for carrying out commercial lake and (or) cage economic activities are divided into international, national and local in importance.

Fisheries reservoirs and (or) sites of international importance include reservoirs located on the territory of the Republic of Kazakhstan and neighboring states included in the list approved by the authorized body in coordination with the authorized body in the field of protection and use of the water fund.

Fisheries reservoirs and (or) sites of national significance include reservoirs and (or) sites located on the territory of two or more regions included in the list approved by the authorized body in coordination with the authorized body in the field of protection and use of water resources.

Fishery reservoirs and (or) sites of local significance include all other reservoirs and (or) sites included in the list approved by the local executive body of regions, cities of republican significance and the capital after coordination with the basin water inspectorate for the protection and regulation of the use of water resources and the territorial subdivision of the department of the authorized body.

2. The lists of fishery reservoirs and (or) sites of international, national and local significance include reservoirs and (or) sites that are recognized as promising for lake-commercial and (or) cage economic activities based on certification. Certification is carried out on the basis of scientific research by local executive bodies of regions, cities of republican significance and the capital in accordance with the rules approved by the authorized body, at the expense of budgetary funds, unless otherwise provided for in paragraph 3 of this Article.

When conducting scientific research in reservoirs for the implementation of lake-commercial and (or) garden economic activities, the minimum water level determined by the technical parameter of the reservoir is taken into account.

3. If there is no reservoir in the list of fisheries reservoirs and (or) sites of local significance located on a land plot privately owned and (or) in temporary land use by an individual and (or) a non-governmental legal entity, such persons have the right to conduct scientific research at their own expense to certify it in accordance with the rules approved by the Government of the Russian Federation. by the authorized body.

4. Fishery reservoirs and (or) sites of international, national and local significance for the implementation of lake-commercial and (or) cage economic activities are fixed in accordance with the procedure provided for in Articles 10 and 11 of this Law.

5. On fixed fishing reservoirs and (or) sites, including within the limits of water protection strips provided for carrying out lake-commercial and (or) cage economic activities, it is prohibited:

1) watering of farm animals, with the exception of watering sites and other devices that prevent pollution and clogging of reservoirs in the order of general water use;

2) economic and other activities that worsen the qualitative and hydrological condition (pollution, clogging, depletion) of reservoirs;

3) amateur (sport) fishing, with the exception of the cases provided for in paragraph 5 of Article 14 of this Law;

4) otherwise provided for by the laws of the Republic of Kazakhstan.
