Declaration on the Development of Friendly relations and Cooperation between the Republic of Kazakhstan and Romania

The Republic of Kazakhstan and Romania, hereinafter referred to as the Parties, striving to develop friendly relations and cooperation, wishing to strengthen mutually beneficial partnership relations between the two sovereign states, convinced that the development of partnership relations will contribute to the expansion of cooperation in the political, economic, social and cultural fields and create opportunities for the full use of the material and intellectual resources of both countries in the interests of peace and stability in their regions, Reaffirming commitment to the principles The Charter of the United Nations and the relevant documents of the Organization for Security and Co-operation in Europe declare the following:
1. The parties will develop their relations in the spirit of mutual respect, trust and partnership based on respect for the principles of independence, sovereignty, territorial integrity and inviolability of the borders of both States. The parties reaffirmed their support for the universally recognized values of democracy, respect for human rights and a market economy. The parties will provide mutual support for actions taken in the interests of building democratic structures in both countries and developing market economy mechanisms. The parties will cooperate on a bilateral basis, as well as within the framework of the United Nations, the Organization for Security and Co-operation in Europe and other international organizations. The Kazakh side expressed its support for Romania's candidacy for the OSCE chairmanship in 2001. The Romanian side expressed its support for the candidacy of the Republic of Kazakhstan for full membership in the World Trade Organization and its desire to participate as an observer in the Black Sea Economic Cooperation Organization and the Danube Commission.
2. The Parties, reaffirming their commitment to the principles of respect for the territorial integrity of States and human rights, advocate the settlement of all disputes exclusively by peaceful means in accordance with the Charter of the United Nations and the principles of the Organization for Security and Co-operation in Europe. The parties express their will to implement the pan-European agreements on establishing trust and security and fulfilling the obligations arising from the relevant agreements.
3. The parties will assist each other in the process of integration with European and Euro-Atlantic political and economic organizations in order to strengthen the climate of trust and security throughout the OSCE area, and will strive for an immediate peaceful settlement of conflicts and the prevention of the emergence of new hotbeds of conflict. Both States attach great importance to bilateral and multilateral cooperation, in particular within the framework of the Euro-Atlantic Partnership Council and the NATO Partnership for Peace Program, which are designed to play an important role in strengthening security and regional stability.
4. The parties will promote the development of political dialogue, intergovernmental and parliamentary relations at various levels and will hold consultations on bilateral and international issues. The parties agreed to intensify consultations and cooperation between the Ministries of Foreign Affairs in accordance with the signed Protocol. The Kazakh side confirmed its decision to open a permanent diplomatic mission in Bucharest. 5. The two countries will promote mutually beneficial cooperation, including trade based on market principles, and will take appropriate measures to ensure favorable conditions for such cooperation, including the protection of investments and technologies. The parties will promote cooperation between state-owned enterprises and private firms, taking into account the specifics of small and medium-sized businesses, and will also share experiences and provide mutual assistance in training personnel and developing a market economy. The parties will encourage contacts between the business and financial circles of both countries in order to significantly increase the volume of bilateral trade exchange and economic cooperation. In this regard, the Parties positively assess the results of the second session of the Kazakh-Romanian intergovernmental commission (Almaty, June 26-27, 1998), the decision to exchange economic missions, establish a joint Chamber of Commerce and Industry and the Republic of Kazakhstan-Romania business club. The parties will promote the deepening of business ties between the two countries by agreeing and implementing contracts and bilateral agreements, in particular in the areas of: - establishment of joint ventures and participation in the modernization and reconstruction of Kazakhstani light industry enterprises, - supply of oil equipment and petrochemical equipment, as well as equipment and spare parts for the metallurgical industry, - exploring alternative oil export routes. and gas, - creation of joint ventures in the fields of production, trade and services, - joint construction of energy facilities, - conclusion of legal documents on the protection of investments, technologies and patents, as well as intellectual property rights, - cooperation between financial and banking institutions, taking into account the need to support small and medium-sized businesses.
6. The Parties will cooperate in the development of transport links and related infrastructure. The parties agreed to prepare and sign an agreement on multimodal transport. The parties will take steps to modernize and develop telecommunications. The Parties attach exceptional importance to the creation and operation of the Eurasian transport corridor, which is an important means of developing trade and economic cooperation, and support efforts aimed at ensuring the sustainable development of this corridor. The parties stressed the important role of the Republic of Kazakhstan and Romania in the development of a transcontinental route in both directions for normal transit in conditions of safety for goods and services. The parties decided to work closely together to successfully complete the TRACECA and INOGATE projects with the support of the European Union by maximizing the use of assistance programs from the European Union. The Romanian side informed the Kazakh side about the possibilities of processing Kazakh oil at Romanian refineries. The Kazakh side is interested in the possibilities of the port of Constanta and the Romanian oil industry in the concretization of the project of the Southeastern European line of transportation and processing of Caspian oil. It was decided to create a joint working group to study the advantages of the Constanta-Trieste main pipeline project.
7. Both States will contribute to the implementation of regional and international cooperation programmes in the field of environmental protection.
8. The Parties will promote the establishment of direct contacts between government organizations and institutions of culture, education, health and social services, computer science and non-governmental organizations. The parties will share their experience and provide mutual support in the field of training managers and scientific and technical staff. The parties will promote cooperation in the field of mutual study of the national culture and languages of both countries, the dissemination of literature of the other country, strengthening ties and contacts between researchers, creative intelligentsia, representatives of the press, broadcasting and cinematography. The parties will also promote the exchange of information on youth and sports, contacts between citizens of the two countries, professional societies and other non-governmental organizations. The parties will support the development of contacts, as well as mutual trips of citizens for business and professional purposes, through tourism, in groups or individually.
9. The Parties will create favorable conditions for the exercise of the rights of citizens of Kazakhstan of Romanian origin and citizens of Romania of Kazakh origin to preserve their ethnic, cultural, linguistic and religious identity, on the basis of equality, without discrimination, in accordance with generally accepted international standards.
10. The Parties will closely cooperate at the bilateral level, as well as within the framework of regional and other international organizations, in the fight against threats to peace and international stability, organized crime and corruption, international terrorism, drug trafficking, art, weapons, other prohibited items, forged documents, as well as illegal migration.
11. This Declaration does not affect the rights and obligations arising from international treaties, both bilateral and multilateral, concluded separately by each State with a third party.
Done in Bucharest on September 21, 1998, in two originals, each in the Kazakh, Romanian and Russian languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Declaration, the Parties will be guided by the text in Russian.
