M O T I O N
Your Honour is currently considering the claim filed by the Claimant E. Kh. A. against the Defendant BII for recovery of damages caused to property, Case No. 5143-26-00-2/1967.
I disagree with the conclusion of the forensic expert issued in this case. The reason is that the disputed house was built in 1957. Therefore, the technical condition of the Claimant's house and its natural wear and tear were not taken into account. The cost of restoring the house was overestimated.
The Defendant's house was partially demolished. The part of the house located on the Claimant's side was not demolished. The expert did not determine to what extent the demolished part of the Defendant's house affected the Claimant's house.
In order to clarify the circumstances, I request that the following questions be submitted to the forensic expert:
- Is there any damage to the house No. 51 located at: Turkistan Region, Maktaral District, Maktaral Rural District, Al-Farabi locality, Tauelsizdik Street; if there is damage, was it caused by the demolition of the house, or was it caused by the age of the house (natural wear and tear, the house having been built in 1957)?
- To examine the integrity and safety of the second apartment before and after the demolition works.
- To calculate the actual material cost of the damage caused to house No. 51 located at: Turkistan Region, Maktaral District, Maktaral Rural District, Tauelsizdik Street (if there is any damage).
Based on the foregoing, I request that a forensic examination be appointed and that the forensic examination on the above questions be conducted by the Republican State Enterprise on the Right of Economic Management “Institute of Forensic Examinations in the City of Shymkent”.
