M O T I O N
Civil case is being considered in your proceedings upon the claim of Aoy G.T. against LLP “Dental Clinic SA” for consumer rights protection and recovery of damages, treatment expenses and compensation for moral harm.
Pursuant to Article 169, Paragraph 1 of the Civil Procedure Code of the Republic of Kazakhstan, “The Plaintiff shall have the right to change the grounds or subject matter of the claim, increase or reduce the amount of the claims by submitting a written application before the completion of the preparation of the case for trial or before the court retires to the deliberation room, if there is no need to conduct additional procedural actions.”
In connection with the foregoing, we reduce the amount of the claim in respect of compensation for moral harm from 3,000,000 tenge to 300,000 tenge. The remaining claims are left unchanged.
I REQUEST THE COURT
- To accept the reduction of the claim amount in respect of compensation for moral harm to 300,000 (three hundred thousand) tenge.
- To consider the case taking into account the amended amount of the claims.
