MOTION
A criminal case concerning Boi Mi Tursungalievna on the fact of fraudulent acts is currently pending before the Police Department under the Medeu District Police Department of the Almaty City Police Department.
Pursuant to Article 24 of the Criminal Procedure Code of the Republic of Kazakhstan, the investigator is obliged to take all measures provided for by law to conduct a comprehensive, complete and objective examination of the circumstances necessary and sufficient for the proper resolution of the case.
The suspect, Ba M.T., has reconciled with the victims Koi A.T., Aoi S.T. and Kym A.G. through mediation. The relevant agreements were submitted to the pre-trial investigation authority and attached to the case materials.
According to the reconciliation agreements, the damage suffered by all the victims has been fully compensated. The victims have no claims against Boi M.T. and agree with the arguments presented by Boi M.T.
Pursuant to Article 70 of the Criminal Procedure Code of the Republic of Kazakhstan, defence counsel has the right to file motions.
Pursuant to Article 99 of the Criminal Procedure Code of the Republic of Kazakhstan, a motion shall be considered and resolved immediately after it is filed. Where it is impossible to make an immediate decision on the motion, it shall be resolved no later than three days from the date of its filing.
Based on the foregoing, I REQUEST:
– to conduct additional questioning of the victims Koi A.T., Aoi S.T. and Ka A.G.
