On amendments to the Criminal Code of the Republic of Kazakhstan and the Criminal Procedure Code of the Republic of Kazakhstan
The Law of the Republic of Kazakhstan dated January 3, 2026 No. 252-VIII SAM
Article 1. To make additions to the following legislative acts of the Republic of Kazakhstan:
1. To the Criminal Code of the Republic of Kazakhstan dated July 3, 2014:
add article 380-3 to read as follows:
"Article 380-3. Threatening or using violence against a medical professional or an ambulance driver
1. The threat of violence against a medical worker or an ambulance driver in the performance or in connection with the performance of his official or professional duties, or out of revenge for their performance –
is punishable by a fine in the amount of two hundred to five hundred monthly calculation indices, or correctional labor in the same amount, or community service for up to three hundred hours, or restriction of liberty for up to two years, or imprisonment for the same term.
2. The act provided for in the first part of this Article, committed:
1) in relation to two or more persons;
2) a group of persons, a group of persons by prior agreement;
3) repeatedly;
4) in an emergency situation or during mass riots;
5) in the area where a state of emergency has been declared, or in the area of the anti-terrorist operation, –
is punishable by restriction of liberty for a term of two to three years or imprisonment for the same term.
3. The use of violence that is not dangerous to life or health against persons and for the reasons specified in the first part of this article, –
is punishable by a fine in the amount of five hundred to one thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to six hundred hours, or restriction of liberty for a term of two to three years, or imprisonment for the same term.
4. The act provided for in the third part of this Article, committed:
1) in relation to two or more persons;
2) a group of persons, a group of persons by prior agreement;
3) repeatedly;
4) in an emergency situation or during mass riots;
5) in the area where a state of emergency has been declared, or in the area of the anti-terrorist operation, –
is punishable by restriction of liberty for a term of three to seven years or imprisonment for the same term.
5. The use of violence dangerous to life or health against persons and for the reasons specified in the first part of this article, –
is punishable by imprisonment for a term of five to ten years.
6. The act provided for in part five of this Article, committed by:
1) in relation to two or more persons;
2) a group of persons, a group of persons by prior agreement;
3) repeatedly;
4) in an emergency situation or during mass riots;
5) in the area where a state of emergency has been declared, or in the area of the anti-terrorist operation, –
is punishable by imprisonment for a term of seven to twelve years.".
2. To the Criminal Procedure Code of the Republic of Kazakhstan dated July 4, 2014:
1) add the words "380-3 (parts four, five and six)" to the second part of Article 187 after the numbers "380-2".;
2) add the words "380-3 (parts one, two and three)" to the second part of Article 191 after the numbers "379".
Article 2. This Law shall enter into force sixty calendar days after the date of its first official publication.
