On approval of the Rules for the development, coordination and approval of interregional territorial development schemes

In accordance with subparagraph 67) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. To approve the attached Rules for the development, coordination and approval of interregional territorial development schemes, in accordance with Annex 1 to this order.

     2. Invalidate it:

     1) Order of the Acting Minister of Industry and Construction of the Republic of Kazakhstan dated October 23, 2023 No. 36 "On Approval of the Rules for the Development, Coordination and Approval of Interregional Territorial Development Schemes" (registered in the Register of State Registration of Regulatory Legal Acts No. 33584);

     2) Order of the Minister of Industry and Construction of the Republic of Kazakhstan dated May 22, 2025 No. 175 "On Amendments to the Order of the Acting Minister of Industry and Construction of the Republic of Kazakhstan "On Approval of the Rules for the Development, Coordination and Approval of Interregional Territorial Development Schemes" dated October 23, 2023 No. 36" (registered in the Register of State Registration of Regulatory Legal Acts acts No. 36150).

     3. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     4. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     5. This order will enter into force on July 1, 2026 and is subject to official publication.

Rules for the development, coordination and approval of interregional territorial development schemes

Chapter 1. General provisions

     1. These Rules for the Development, Coordination and Approval of interregional territorial development schemes (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 67) of Article 24 of the Building Code of the Republic of Kazakhstan (hereinafter referred to as the Code) and establish the procedure for the development, coordination and approval of interregional territorial development schemes for two or more regions (or parts thereof), agglomerations.

Chapter 2. Procedure for the development, coordination and approval of interregional territorial development schemes

     2. The interregional Territorial development Scheme (hereinafter referred to as the Interregional Scheme) is developed in accordance with the general scheme of organization of the territory of the Republic of Kazakhstan, is intended for mutually coordinated (consolidated) architectural, urban planning and construction activities in the territories of two or more regions (or parts thereof), agglomerations and defines:

     1) zoning of the territory;

     2) design solutions for the integrated development of the system of settlement and placement of productive forces, transport, engineering, social and recreational infrastructures of regional and interregional significance;

     3) design solutions for the rational use of natural resources and economic activities, provision of resources, improvement of the environmental situation;

     4) design solutions for the protection of territories from the effects of natural and man-made emergencies and civil defense measures;

     5) project proposals for the formation of territories of active economic development with the definition of measures for their infrastructural support;

     6) other provisions established by the assignment for the development of an interregional territorial development scheme.

     3. The organization of the development of Interregional Schemes is carried out by the authorized body for architecture, urban Planning and construction (hereinafter referred to as the Customer) together with local executive bodies (hereinafter referred to as the MIO).

     The development of Interregional schemes within the framework of the state assignment is carried out by the republican state enterprise on the right of economic management in the field of state urban planning and cadastre, established by a decree of the Government of the Republic of Kazakhstan, in accordance with paragraph 7 of Article 69 of the Code.

     4. The customer draws up and approves the design assignment in accordance with Appendix 1 to these Rules.

     5. The initial materials for the development of Interregional Schemes are prepared in accordance with the design assignment by the interested government agencies, as well as the relevant M&E organizations, and are transferred to the developer (general designer) within ten working days from the date of receipt of the request.

     6. The customer submits the draft Interregional schemes for consideration and approval to the interested state bodies after passing a comprehensive urban planning examination.

     7. Prior to approval, the draft Interregional Scheme undergoes a comprehensive urban planning examination in accordance with the Rules for conducting a comprehensive urban planning examination of urban projects approved by the authorized body for Architecture, Urban Planning and Construction, in accordance with subparagraph 12) of Article 24 of the Code.

     8. Interregional schemes that have not passed a comprehensive urban planning examination and have not received its positive conclusion are not subject to approval.

     9. Interregional schemes are approved by the Government of the Republic of Kazakhstan.

     10. The approved part of the Interregional Scheme is the main provisions, the main drawing and the main technical and economic indicators of the draft Interregional Scheme in accordance with Annex 2 to these Rules.

     11. The provision of approved Interregional schemes in vector form for entry into the database of the state urban planning cadastre is carried out in accordance with the Rules for Maintaining and providing information and (or) information from the state urban planning cadastre, approved by the authorized body for architecture, Urban Planning and construction in accordance with subparagraph 47) of Article 24 of the Code.
